মুহাম্মদ ইবন ইদরীস (রহঃ) ... আবদুল্লাহ ইবন মাসউদ (রাঃ) হতে বর্ণিত:
আমি রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম-কে বলতে শুনেছিঃ যখন ক্রেতা এবং বিক্রেতা মূল্যের ব্যাপারে বিরোধ করবে, আর তাদের মধ্যে সাক্ষী না থাকবে, তখন বিক্রেতার কথা ধর্তব্য হবে অথবা তারা সে বেচাকেনা পরিত্যাগ করবে।
Abdullah said:"I heard the Messenger of Allah say: 'If the two parties to a transaction disagree, and neither of them has any proof, then it is as the owner of the goods says, or they may cancel it
তার চাচা যিনি রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম এর সাহাবী ছিলেন, তাঁর নিকট বর্ণনা করেছেন যে, রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম এক বেদুঈন হতে একটি ঘোড়া ক্রয় করলেন। তারপর বেদুঈন ঘোড়ার মূল্য গ্রহণের জন্য তার পিছনে চলল। নবী সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম দ্রুত চলছিলেন আর সে ধীরে। এ সময় লোকজন তার সামনে পড়লে তারা ঘোড়ার দরদাম করতে লাগলো। তারা জানতো না যে, রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম তা ক্রয় করেছেন। তাই তারা তার স্থিরীকৃত মূল্যের উপর আরও মূল্য বাড়িয়ে বলতে লাগলো। শেষে ঐ বেদুঈন রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম-কে আহবান করে বলতে লাগল, আপনি যদি এটা ক্রয় করেন তবে করুন, না হয় আমি অন্যের নিকট বিক্রি করে দিচ্ছি। রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম এ কথা শুনে দাঁড়ালেন এবং বললেনঃ তুমি কি এটা আমার নিকট বিক্রি করনি? সে বললোঃ না, আমি এটা আপনার নিকট বিক্রি করিনি। তিনি বললেনঃ আমি এটা তো তোমার থেকে ক্রয় করে নিয়েছি। কোন কোন লোক এ ব্যাপারে রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম এর পক্ষ অবলম্বন করলো, আর কেউ কেউ বেদুঈনের পক্ষ অবলম্বন করলো। বেদুইন বললোঃ তা হলে আপনি সাক্ষী পেশ করুন, যে সাক্ষ্য দেবে যে, আমি এটা আপনার নিকট বিক্রয় করেছি। তখন খুযায়মা ইবন সাবিত (রাঃ) বললেনঃ আমি সাক্ষ্য দিচ্ছি যে, তুমি তাঁর নিকট এটা বিক্রয় করেছ। তখন রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম খুযায়মাকে জিজ্ঞাসা করলেনঃ তুমি কেন সাক্ষ্য দিচ্ছ (তুমি তো উপস্থিত ছিলে না)? তিনি বললেন, ইয়া রাসূলাল্লাহ! আপনাকে সত্য নবী বলে বিশ্বাস করার দরুন। বর্ণনাকারী বলেনঃ এরপর রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম খুযায়মা (রাঃ)-এর একার সাক্ষ্যকে দুই ব্যক্তির সাক্ষ্যরূপে সাব্যস্ত করেন।
It was narrated from 'Umarah bin Khuzaimah that his paternal uncle, who was one of the companions of the Prophet told him, that:the Prophet bought a horse from a Bedouin and asked him to follow him, so that he could pay him for the horse. The Prophet hastened but the Bedouin was slow. Men started to talk to the Bedouin and make offers for the horse, and they did not realize that the Prophet had bought it, until some of them offered more than the Prophet had bought it for. Then the Bedouin called out to the Prophet and said; "Are you going to buy this horse or shall I sell it?" The Prophet stood up when he heard him calling and said: "Have I not bought it from you?" He said: 'No, by Allah, I have not sold it to you, and the Prophet said "I bought it from you." The people started to gaiter around the Prophet and the Bedouion as they were talking, and the Bedouin started to say: "Bring a witness who will testify that you bought it. " Khuzaimah bin habit said: "I bear witness that you bought it" The Prophet turned to Khunzimah and said: "Why are you bearing witness?" He said: "Because I know that you are truthful, O Messenger of Allah" made the testimony of Khuzaimah equivalent to the testimony of two men. (sahih)
ইবরাহীম ইবন হাসান, ইউসুফ ইবন সাঈদ ও আবদুর রহমান ইবন খালিদ (রহঃ) ... আবদুল মালিক ইবন উবায়দ (রহঃ) বলেন, একদা আমরা আবু উবায়দা ইবন আবদুল্লাহ্ ইবন মাসউদ-এর নিকট উপস্থিত হলাম। এমন সময় সেখানে দুইজন লোক আসল, যারা মাল বিক্রি করেছে। এক ব্যক্তি বললোঃ আমি তো এত মূল্যে খরিদ করেছি। অন্যজন বললোঃ এত মূল্যে বিক্রয় করেছি। আবু উবায়দা (রাঃ) বললেনঃ ইবন মাসউদ (রাঃ)-এর নিকট এরূপ একটি মোকদ্দমা আসলে তিনি বললেনঃ আমি রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম এর নিকট উপস্থিত ছিলাম। তাঁর নিকট অনুরূপ এক মোকদ্দমা আসলে তিনি বিক্রেতাকে শপথ করতে বললেন এবং ক্রেতাকে বললেন, এই মূল্যে হয় তুমি তা ক্রয় কর, না হয় তা পরিত্যাগ কর।
It was narrated that 'Abdul-Malik bin'Ubaid said:"We were with Abu 'Ubaidah bin 'Abdullah bin Mas'ud when two men who were involved in a transaction came to him. One of them said: 'I bought it for such and such', and the other said; 'I sold it to him for such and such,' Abu 'Ubaidah said" 'something like this was brought to Ibn Masud, and he said; I was with something like this was brought to him. He told the seller to swear an oath, them he gave the purchaser the choice; If he wished, he could buy it, and if he wished he could cancel (the transaction)
তিনি বলেন, রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বলেছেনঃ প্রত্যেক এজমালি সম্পত্তিতে শুফআ (ক্রয়ের অগ্রাধিকার) রয়েছে, তা বাগান হোক অথবা ঘরবাড়ি হোক। কাজেই এক শরীকের জন্য তা বিক্রয় করা বৈধ হবে না অন্য শরীককে না জানিয়ে। যদি বিক্রয় করে ফেলে, তবে অন্য শরীকই তার বেশি হকদার, যতক্ষণ না সে অনুমতি দান করে।
it was narrated that Jabir said:"The Messenger of Allah said: 'Pre-emption is to be given in everything that is shared, whether it is a house or a garden. It is not right to sell it before informing one's partner, and if he sells it he (the partner) has more right to it, unless he gives Permission to sell it to someone else
