তিনি বলেন, রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বলেছেনঃ প্রত্যেক এজমালি সম্পত্তিতে শুফআ (ক্রয়ের অগ্রাধিকার) রয়েছে, তা বাগান হোক অথবা ঘরবাড়ি হোক। কাজেই এক শরীকের জন্য তা বিক্রয় করা বৈধ হবে না অন্য শরীককে না জানিয়ে। যদি বিক্রয় করে ফেলে, তবে অন্য শরীকই তার বেশি হকদার, যতক্ষণ না সে অনুমতি দান করে।
it was narrated that Jabir said:"The Messenger of Allah said: 'Pre-emption is to be given in everything that is shared, whether it is a house or a garden. It is not right to sell it before informing one's partner, and if he sells it he (the partner) has more right to it, unless he gives Permission to sell it to someone else
আহমদ ইব্ন হাফস (রহঃ) ... ইবন আব্বাস (রাঃ) হতে বর্ণিত:
তিনি বলেন, রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বন্টনের পূর্বে গনীমতের মাল বিক্রয় করতে নিষেধ করেছেন, (যুদ্ধবন্দীদের মধ্যে) যারা অন্তঃসত্তা, সন্তান ভূমিষ্ঠ না হওয়া পর্যন্ত তাদের সাথে সহবাস করতে নিষেধ করেছেন। আর বন্য জন্তুর মধ্যে যেসব দাঁতে শিকার করে, সেগুলোর গোশত খেতে নিষেধ করেছেন।
It was narrated that Ibn 'Abbas said:"The Messenger of Allah forbade selling something from the spoils of war prior to its distribution, having intercourse with a pregnant woman until she gives birth, and (eating) the flesh of any predator that has fangs
তার চাচা যিনি রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম এর সাহাবী ছিলেন, তাঁর নিকট বর্ণনা করেছেন যে, রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম এক বেদুঈন হতে একটি ঘোড়া ক্রয় করলেন। তারপর বেদুঈন ঘোড়ার মূল্য গ্রহণের জন্য তার পিছনে চলল। নবী সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম দ্রুত চলছিলেন আর সে ধীরে। এ সময় লোকজন তার সামনে পড়লে তারা ঘোড়ার দরদাম করতে লাগলো। তারা জানতো না যে, রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম তা ক্রয় করেছেন। তাই তারা তার স্থিরীকৃত মূল্যের উপর আরও মূল্য বাড়িয়ে বলতে লাগলো। শেষে ঐ বেদুঈন রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম-কে আহবান করে বলতে লাগল, আপনি যদি এটা ক্রয় করেন তবে করুন, না হয় আমি অন্যের নিকট বিক্রি করে দিচ্ছি। রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম এ কথা শুনে দাঁড়ালেন এবং বললেনঃ তুমি কি এটা আমার নিকট বিক্রি করনি? সে বললোঃ না, আমি এটা আপনার নিকট বিক্রি করিনি। তিনি বললেনঃ আমি এটা তো তোমার থেকে ক্রয় করে নিয়েছি। কোন কোন লোক এ ব্যাপারে রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম এর পক্ষ অবলম্বন করলো, আর কেউ কেউ বেদুঈনের পক্ষ অবলম্বন করলো। বেদুইন বললোঃ তা হলে আপনি সাক্ষী পেশ করুন, যে সাক্ষ্য দেবে যে, আমি এটা আপনার নিকট বিক্রয় করেছি। তখন খুযায়মা ইবন সাবিত (রাঃ) বললেনঃ আমি সাক্ষ্য দিচ্ছি যে, তুমি তাঁর নিকট এটা বিক্রয় করেছ। তখন রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম খুযায়মাকে জিজ্ঞাসা করলেনঃ তুমি কেন সাক্ষ্য দিচ্ছ (তুমি তো উপস্থিত ছিলে না)? তিনি বললেন, ইয়া রাসূলাল্লাহ! আপনাকে সত্য নবী বলে বিশ্বাস করার দরুন। বর্ণনাকারী বলেনঃ এরপর রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম খুযায়মা (রাঃ)-এর একার সাক্ষ্যকে দুই ব্যক্তির সাক্ষ্যরূপে সাব্যস্ত করেন।
It was narrated from 'Umarah bin Khuzaimah that his paternal uncle, who was one of the companions of the Prophet told him, that:the Prophet bought a horse from a Bedouin and asked him to follow him, so that he could pay him for the horse. The Prophet hastened but the Bedouin was slow. Men started to talk to the Bedouin and make offers for the horse, and they did not realize that the Prophet had bought it, until some of them offered more than the Prophet had bought it for. Then the Bedouin called out to the Prophet and said; "Are you going to buy this horse or shall I sell it?" The Prophet stood up when he heard him calling and said: "Have I not bought it from you?" He said: 'No, by Allah, I have not sold it to you, and the Prophet said "I bought it from you." The people started to gaiter around the Prophet and the Bedouion as they were talking, and the Bedouin started to say: "Bring a witness who will testify that you bought it. " Khuzaimah bin habit said: "I bear witness that you bought it" The Prophet turned to Khunzimah and said: "Why are you bearing witness?" He said: "Because I know that you are truthful, O Messenger of Allah" made the testimony of Khuzaimah equivalent to the testimony of two men. (sahih)
কুতায়বা (রহঃ) ... আবদুল্লাহ্ ইবন উমর (রাঃ) থেকে বর্ণিত যে, আয়েশা (রাঃ) একজন দাসী ক্রয় করে মুক্ত করার ইচ্ছা করলে তার মালিকেরা বললোঃ আমরা এই দাসীকে আপনার নিকট এই শর্তে বিক্রয় করতে পারি যে, তার ওয়ালা আমরা পাবো। তিনি তা রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম এর নিকট বর্ণনা করলে, তিনি বললেনঃ এই শর্ত যেন তোমাকে ক্রয় করা হতে বিরত না রাখে। কেননা ‘ওয়ালা’ ঐ ব্যাক্তিরই হবে যে মুক্ত করবে।
It was narrated from'Abdullah bin 'Umar that 'Aishah wanted to but a slave woman to set her free, but her people said:"We will sell her to you on condition that her loyalty (Walla) is to us," She mentioned that top the Messenger of Allah and he said: "That should not stop you. Loyalty belongs to the one who sets the slave free
