সাহল ইবন আবু হাসমা নামক এক আনসারী তাকে সংবাদ দিয়েছেন যে, তার গোত্রের কয়েকজন খায়বরে গমন করেন। সেখানে তারা পৃথক হয়ে যান পরে তারা তাদের একজনকে নিহত অবস্থায় পেলেন। তারা যে স্থানে নিহত ব্যক্তিকে পেলেন, সেখানকার লোকজনকে বললেন, তোমরা আমাদের লোককে হত্যা করেছ। তারা বললোঃ আমরা তাকে হত্যা করিনি এবং হত্যাকারীকে আমরা চিনিও না। এরপর তারা রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম এর নিকট উপস্থিত হয়ে বললেনঃ ইয়া রাসূলাল্লাহ! আমরা খায়বার গিয়েছিলাম, সেখানে আমরা আমাদের এক ব্যক্তিকে নিহত পেয়েছি। তিনি বললেনঃ বয়সে বড় ব্যক্তির সম্মান কর। তিনি বললেনঃ তোমরা কি সাক্ষী উপস্থিত করতে পারবে যে, কে হত্যা করেছে? তারা বললেনঃ আমাদের কোন সাক্ষী নেই। তিনি বললেনঃ তা হলে ইয়াহূদীরা তোমাদের সামনে শপথ করবে। তারা বললেন, আমরা ইয়াহূদীর শপথ বিশ্বাস করি না। রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম এর নিকট ঐ ব্যক্তির রক্ত বৃথা যাওয়া পছন্দ হলো না। কাজেই তিনি সাদকার উট থেকে একশত উট দিয়াত স্বরূপ তাদের দিয়ে দেন।
It was narrated from Sa'eed bin 'Ubaid At-Ta'l from Bushair bin Yasar who said:"A man from among the Ansar who was called Sahl bin Abi Hathmah told him that some of his people went to Khaibar, where they went their separate ways. Then they found one of their numbers slain. They said to those in whose land they found him: 'You killed our companion!' They said: 'We did not kill him and we do not know who killed him.' They went to the prophet of Allah and said: 'O Prophet of Allah, we went to Khaibar and we found one of our number slain.' The Messenger of Allah said: 'Let the elders speak first.' And he said to them: 'Bring proof of the one whom you suspect killed him.' They said: 'We do not have any proof.' He said: "Then let them swear an oath to you.' They said" 'We will not accept the oath of the Jews.' The Messenger of Allah did not want his blood to have been shed with no Justice done, so he paid a Diyah of one hundred camels from the Sadaqah." আবদুল্লাহ ইবন সাহল আনসারী এবং মুহায়্যিসা ইবন মাসউদ খায়বর গমন করার পর নিজ নিজ কাজের জন্য পৃথক হয়ে যান। তারপর আবদুল্লাহ ইবন সাহল নিহত হন। মুহায়্যিসা সেখান থেকে ফিরে আসেন। এরপর তিনি, তাঁর ভাই হুওয়ায়্যিসা এবং আবদুর রহমান ইবন সাহল রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম এর নিকট উপস্থিত হন। আবদুর রহমান তাঁর ভাই হিসাবে প্রথমে কথা শুরু করেন। রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বললেনঃ বয়সে যে বড়, তাকে সম্মান কর। তখন হুওয়ায়্যিসা এবং মুহায়্যিসা কথা বলতে শুরু করেন। তারা আবদুল্লাহ ইবন সাহলের অবস্থা বর্ণনা করলে, রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম তাদেরকে বললেনঃ তোমরা পঞ্চাশজন শপথ করে কি তোমাদের লোকের হত্যাকারীর বিচার লাভের অধিকার সাব্যস্ত করতে পারবে? ইমাম মালিক (রহঃ) বলেন, ইয়াহইয়া বলেছেনঃ বুশায়র মনে করেন, রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম নিজে দিয়াত আদায় করে দেন।
It was narrated from Bushair bin Yasar that:'Abdullah bin Sahl Al-Ansari and Muhayysah bin Mas'ud went out to Khaibar, where they went their separate ways to go about their business. 'Abdullah bin Sahl was killed, and Muhayysah came (to Madinah) and went with his brother Huwayysah and 'Abdur-Rahman bin Sahl to the Messenger of Allah. 'Abdur-Rahaman started to speak, because of his position as brother (of the slain man) but the Messenger of Allah said: "Let the elders speak first." So Huyysah and Muhayysah spoken, and told him about what happened to 'Abdullah bin Sahl. The Messenger of Allah said to them: "Will you sewer fifty oaths, then you will receive compensation or be entitled to retaliate?" (In his narration) Malik said: "Yahya said: 'Bushair said that the Messenger of Allah paid the blood money himself, but Sa'eed bin 'Ubaid At-Ta'l disagreed with them (in reporting that)
أَخْبَرَنَا مُحَمَّدُ بْنُ مَعْمَرٍ، قَالَ حَدَّثَنَا رَوْحُ بْنُ عُبَادَةَ، قَالَ حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ الأَخْنَسِ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، أَنَّ ابْنَ مُحَيِّصَةَ الأَصْغَرَ، أَصْبَحَ قَتِيلاً عَلَى أَبْوَابِ خَيْبَرَ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " أَقِمْ شَاهِدَيْنِ عَلَى مَنْ قَتَلَهُ أَدْفَعْهُ إِلَيْكُمْ بِرُمَّتِهِ " . قَالَ يَا رَسُولَ اللَّهِ وَمِنْ أَيْنَ أُصِيبُ شَاهِدَيْنِ وَإِنَّمَا أَصْبَحَ قَتِيلاً عَلَى أَبْوَابِهِمْ قَالَ " فَتَحْلِفُ خَمْسِينَ قَسَامَةً " . قَالَ يَا رَسُولَ اللَّهِ وَكَيْفَ أَحْلِفُ عَلَى مَا لاَ أَعْلَمُ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " فَنَسْتَحْلِفُ مِنْهُمْ خَمْسِينَ قَسَامَةً " . فَقَالَ يَا رَسُولَ اللَّهِ كَيْفَ نَسْتَحْلِفُهُمْ وَهُمُ الْيَهُودُ فَقَسَمَ رَسُولُ اللَّهِ صلى الله عليه وسلم دِيَتَهُ عَلَيْهِمْ وَأَعَانَهُمْ بِنِصْفِهَا .
মুহাম্মদ ইবন মা'মার (রহঃ) ... আমর ইবন শুআয়ব তার পিতার সূত্রে তার দাদা থেকে বর্ণনা করেন যে, মুহায়্যিসার ছােট ছেলে খায়বারের লোকালয়ের সামনে নিহত হন। তখন রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বললেনঃ তুমি হত্যাকারী সম্পর্কে দুইজন সাক্ষী পেশ কর; আমি তাকে তার রশিসহ তোমাদের নিকট সোপর্দ করবো। তিনি বললেনঃ ইয়া রাসূলাল্লাহ্! আমি দুইজন সাক্ষী কোথা হতে আনবো? এতো তাদের দুয়ারে মৃতাবস্থায় পতিত ছিল। তিনি বললেনঃ তবে তুমি পঞ্চাশবার শপথ করবে। তিনি বললেনঃ আমি যা জানি না, তার কসম আমি কি করে করবো? রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বললেনঃ তা হলে ইয়াহুদীদের মধ্য হতে পঞ্চাশজন থেকে আমরা শপথ নিই? তিনি বললেনঃ আমরা তাদের থেকে শপথ নেব, যখন তারা ইয়াহুদী? তখন রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম তার দিয়াত তাদের মধ্যে ভাগ করে দেন; আর অর্ধেক দিয়াত নিজের পক্ষ হতে দিয়ে তাদের সাহায্য করেন।
It was narrated from 'Amr bin Shu'aib, from his father, from his grandfather, that:the younger son of Muhayysah was found slain one morning at the gate of one morning at the gates of Khaibar. The Messenger of Allah said: "Bring two witnesses to (say) who killed him, and he will hand him over to you." He said: "O Messenger of Allah, where shall I get two witnesses? He was found slain in the morning at their gates." He said: "Will you swear fifty oaths?" He said: "O Messenger of Allah, how can I swear concerning something I do not know?" The Messenger of Allah said: "Then will you accept fifty oaths from them?" He said: "O Messenger of Allah, how can we accept their oaths when they are Jews?" So the Messenger of Allah told them (the Jews) to pay the Diyah and he would help them with half
أَخْبَرَنَا مُحَمَّدُ بْنُ مَنْصُورٍ، قَالَ حَدَّثَنَا سُفْيَانُ، قَالَ حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ، عَنْ بُشَيْرِ بْنِ يَسَارٍ، عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ، قَالَ وُجِدَ عَبْدُ اللَّهِ بْنُ سَهْلٍ قَتِيلاً فَجَاءَ أَخُوهُ وَعَمَّاهُ حُوَيِّصَةُ وَمُحَيِّصَةُ وَهُمَا عَمَّا عَبْدِ اللَّهِ بْنِ سَهْلٍ إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم فَذَهَبَ عَبْدُ الرَّحْمَنِ يَتَكَلَّمُ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " الْكُبْرَ الْكُبْرَ " . قَالاَ يَا رَسُولَ اللَّهِ إِنَّا وَجَدْنَا عَبْدَ اللَّهِ بْنَ سَهْلٍ قَتِيلاً فِي قَلِيبٍ مِنْ بَعْضِ قُلُبِ خَيْبَرَ . فَقَالَ النَّبِيُّ صلى الله عليه وسلم " مَنْ تَتَّهِمُونَ " . قَالُوا نَتَّهِمُ الْيَهُودَ . قَالَ " أَفَتُقْسِمُونَ خَمْسِينَ يَمِينًا أَنَّ الْيَهُودَ قَتَلَتْهُ " . قَالُوا وَكَيْفَ نُقْسِمُ عَلَى مَا لَمْ نَرَ قَالَ " فَتُبَرِّئُكُمُ الْيَهُودُ بِخَمْسِينَ أَنَّهُمْ لَمْ يَقْتُلُوهُ " . قَالُوا وَكَيْفَ نَرْضَى بِأَيْمَانِهِمْ وَهُمْ مُشْرِكُونَ فَوَدَاهُ رَسُولُ اللَّهِ صلى الله عليه وسلم مِنْ عِنْدِهِ . أَرْسَلَهُ مَالِكُ بْنُ أَنَسٍ .
মুহাম্মদ ইবন মানসূর (রহঃ) ... সাহল ইবন আবু হাসমা (রাঃ) হতে বর্ণিত:
আবদুল্লাহ ইবন সাহলকে মৃতাবস্থায় পাওয়া গেল, তখন তার ভাই এবং দুই চাচা হুওয়ায়্যিসা এবং মুহায়্যিসা, যারা আবদুল্লাহ (রাঃ)-এর চাচা ছিলেন, রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম এর নিকট উপস্থিত হলেন। আবদুর রহমান প্রথমে কথা বলতে শুরু করলে রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বললেনঃ বয়সে যে বড় তাকে সম্মান কর। তারা বললেনঃ ইয়া রাসূলাল্লাহ্! আমরা আবদুল্লাহ্ ইবন সালকে মৃতাবস্থায় পেয়েছি। আর তাকে হত্যা করে ইয়াহুদীদের এক কূপে ফেলে দেওয়া হয়েছিল। তিনি জিজ্ঞাসা করলেনঃ তোমরা কাকে সন্দেহ কর? তারা বললেনঃ ইয়াহুদীদের উপরই আমাদের সন্দেহ হয়। তিনি বললেনঃ তোমরা কি কসম করে বলতে পার যে, ইয়াহূদীরা তাকে হত্যা করেছে? তারা বললেনঃ আমরা যখন চোখে দেখিনি তখন আমরা কিরূপে কসম করতে পারি? তিনি বলেনঃ তা হলে ইয়াহূদীরা পঞ্চাশজন শপথ করে দায়মুক্ত হয়ে যাবে। তখন তারা বললেনঃ আমরা তাদের শপথ কিরূপে বিশ্বাস করবো? কেননা তারা তো মুশরিক। তখন রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম নিজে তাদের দিয়াত আদায় করে দেন।
It was narrated that Sahl bin Abi Hathmah said:"Abdullah bin Sahl was found slain, and his brother, and two paternal uncles, Huwayysah and Huwayisaah, who were the paternal uncles of 'Abdullah bin Sahl, came to the Messenger of Allah. 'Abdur-Rahman started to speak, but the Messenger of Allah said: "Let the elders speak first." They said: "O Messenger of Allah, we found 'Abdullah bin Sahl slain in one of the dry wells of Khaibar." The prophet said: "Whom do you suspect? They said: "We suspect the Jews." He said: "Will you swear fifty oaths saying that the Jews killed him?" They said: "How can we swear an oath about something that we did not see?" He said: "Then can the Jews swear fifty oaths declaring that they did not kill him?" They said:"How can we accept their oaths, when they are Mushrikun?" So the Messenger of Allah paid the blood money himself. (Sahih) Malik narrated this in Mursal from
