حَدَّثَنِي مَالِكٌ، أَنَّهُ سَمِعَ رَبِيعَةَ بْنَ أَبِي عَبْدِ الرَّحْمَنِ، وَغَيْرَهُ، يَذْكُرُونَ أَنَّ مَكَاتَبًا، كَانَ لِلْفُرَافِصَةِ بْنِ عُمَيْرٍ الْحَنَفِيِّ وَأَنَّهُ عَرَضَ عَلَيْهِ أَنْ يَدْفَعَ إِلَيْهِ جَمِيعَ مَا عَلَيْهِ مِنْ كِتَابَتِهِ فَأَبَى الْفُرَافِصَةُ فَأَتَى الْمُكَاتَبُ مَرْوَانَ بْنَ الْحَكَمِ وَهُوَ أَمِيرُ الْمَدِينَةِ فَذَكَرَ ذَلِكَ لَهُ فَدَعَا مَرْوَانُ الْفُرَافِصَةَ فَقَالَ لَهُ ذَلِكَ فَأَبَى فَأَمَرَ مَرْوَانُ بِذَلِكَ الْمَالِ أَنْ يُقْبَضَ مِنَ الْمُكَاتَبِ فَيُوضَعَ فِي بَيْتِ الْمَالِ وَقَالَ لِلْمُكَاتَبِ اذْهَبْ فَقَدْ عَتَقْتَ ‏.‏ فَلَمَّا رَأَى ذَلِكَ الْفُرَافِصَةُ قَبَضَ الْمَالَ ‏.‏ قَالَ مَالِكٌ فَالأَمْرُ عِنْدَنَا أَنَّ الْمُكَاتَبَ إِذَا أَدَّى جَمِيعَ مَا عَلَيْهِ مِنْ نُجُومِهِ قَبْلَ مَحِلِّهَا جَازَ ذَلِكَ لَهُ وَلَمْ يَكُنْ لِسَيِّدِهِ أَنْ يَأْبَى ذَلِكَ عَلَيْهِ وَذَلِكَ أَنَّهُ يَضَعُ عَنِ الْمُكَاتَبِ بِذَلِكَ كُلَّ شَرْطٍ أَوْ خِدْمَةٍ أَوْ سَفَرٍ لأَنَّهُ لاَ تَتِمُّ عَتَاقَةُ رَجُلٍ وَعَلَيْهِ بَقِيَّةٌ مِنْ رِقٍّ وَلاَ تَتِمُّ حُرْمَتُهُ وَلاَ تَجُوزُ شَهَادَتُهُ وَلاَ يَجِبُ مِيرَاثُهُ وَلاَ أَشْبَاهُ هَذَا مِنْ أَمْرِهِ وَلاَ يَنْبَغِي لِسَيِّدِهِ أَنْ يَشْتَرِطَ عَلَيْهِ خِدْمَةً بَعْدَ عَتَاقَتِهِ ‏.‏ قَالَ مَالِكٌ فِي مُكَاتَبٍ مَرِضَ مَرَضًا شَدِيدًا فَأَرَادَ أَنْ يَدْفَعَ نُجُومَهُ كُلَّهَا إِلَى سَيِّدِهِ لأَنْ يَرِثَهُ وَرَثَةٌ لَهُ أَحْرَارٌ وَلَيْسَ مَعَهُ فِي كِتَابَتِهِ وَلَدٌ لَهُ ‏.‏ قَالَ مَالِكٌ ذَلِكَ جَائِزٌ لَهُ لأَنَّهُ تَتِمُّ بِذَلِكَ حُرْمَتُهُ وَتَجُوزُ شَهَادَتُهُ وَيَجُوزُ اعْتِرَافُهُ بِمَا عَلَيْهِ مِنْ دُيُونِ النَّاسِ وَتَجُوزُ وَصِيَّتُهُ وَلَيْسَ لِسَيِّدِهِ أَنْ يَأْبَى ذَلِكَ عَلَيْهِ بِأَنْ يَقُولَ فَرَّ مِنِّي بِمَالِهِ ‏.‏
রেওয়ায়ত ১১. মালিক (রহঃ) বলেনঃ যে ব্যক্তি স্বর্ণ অথবা রৌপ্যের বিনিময়ে আপন ক্রীতদাসের সহিত মুকাতাবাত করিয়াছে এবং ক্রীতদাসের উপর তাহার কিতাবাতের মধ্যে শর্তারোপ করিয়াছে, সফরের অথবা খেদমতের অথবা কুরবানীর, আর ইহার প্রত্যেকটির নাম নির্দিষ্ট করিয়া দিয়াছে (যাহার শর্ত করিয়াছে কিতাবাতের মধ্যে)। অতঃপর মুকাতাব নির্দিষ্ট সময় আসার পূর্বে তাহার সকল কিস্তি শোধ করিতে সমর্থ হইয়াছে। মালিক (রহঃ) বলেনঃ যখন উহার সকল কিস্তি শোধ করিয়াছে, উহার উপর এই শর্ত (আরোপিত) রহিয়াছে, সে আযাদ হইয়া যাইবে এবং উহার সম্মান পূর্ণ হইয়াছে। এখন লক্ষ্য করিতে হইবে, উহার উপর যে শর্তারোপ করা হইয়াছে খেদমত অথবা প্রবাস অথবা এই জাতীয় অন্য কিছু যাহা উহাকে নিজেই করিতে হইবে। তবে এই জাতীয় শর্তাদি উহা হইতে পরিহার করা হইবে এবং তাহার কর্তার এই জাতীয় কিছুতে অধিকার থাকিবে না। পক্ষান্তরে যে শর্ত হয় কুরবানী; পোশাক অথবা অন্য কোন কিছুর যাহা আদায় করা হয় (এই জাতীয় শর্ত করিয়া থাকিলে) উহা হইবে দীনার, দিরহামের মতো। মুকাতাবের উপর উহার মূল্য নির্ধারিত করা হইবে। অতঃপর সেই অর্থ কিস্তির মাধ্যমে কর্তাকে পরিশোধ করিবে। যতক্ষণ কিস্তির সহিত ইহা আদায় না করিবে ততক্ষণ সে আযাদ হইবে না। মালিক (রহঃ) বলেনঃ আমাদের নিকট সর্বসম্মত সিদ্ধান্ত যাহাতে কোন মতভেদ নাই, তাহা এই—মুকাতাব সেই ক্রীতদাসের মতো যাহাকে তাহার কর্তা দশ বৎসর খেদমত করার (শর্তে) পর আযাদ করিয়াছে। অতঃপর তাহার কর্তা যিনি ক্রীতদাসকে আযাদ করিয়াছে (অর্থাৎ আযাদ করার কথা দিয়াছে শর্তাধীনে) কর্তা মৃত্যুবরণ করিয়াছে দশ বৎসর (অতিবাহিত হওয়ার) পূর্বে। তবে যে (কয় বৎসর বা মাসের) খেদমত অবশিষ্ট রহিয়াছে সে খেদমত কর্তার ওয়ারিসগণের প্রাপ্য হইবে; আর (আযাদীর) পর উহার উত্তরাধিকার পাইবে যে আযাদীর চুক্তি করিয়াছিল সে এবং তাহার পুরুষ সন্তানগণ অথবা আসাবাগণ। মালিক (রহঃ) বলেনঃ এক ব্যক্তি তাহার মুকাতাবের উপর শর্তারোপ করিয়াছে, তুমি প্রবাসে যাইবে না, বিবাহ করিবে না এবং আমার ভূমি (দেশ) হইতে আমার অনুমতি ছাড়া বাহিরে যাইবে না, যদি আমার অনুমতি ছাড়া ইহার কোন একটি কর, তবে তোমার কিতাবাত বাতিল করার ক্ষমতা আমার হাতে। মালিক (রহঃ) বলেনঃ মুকাতাবের কিতাবাত বাতিল করার ক্ষমতা সেই ব্যক্তির হাতে নহে। বরং যদি মুকাতাব এই রকম কোন কর্ম করিয়া থাকে তবে উহার কর্তা বিষয়টি বাদশাহ হাকিম-এর নিকট উত্থাপন করিবে। পক্ষাত্তরে শর্ত করুক বা নাই করুক, মুকাতাবের পক্ষে কর্তার অনুমতি ছাড়া বিবাহ করা জায়েয নহে এবং সে প্রবাসে যাইবে না; এবং কর্তার দেশ হইতে বাহিরে যাইবে না কর্তার অনুমতি ব্যতীত। ইহা এইজন্য — এক ব্যক্তি তাহার মুকাতাবের সহিত মুকাতাবাত করিয়াছে একশত দীনারের বিনিময়ে। মুকাতাবের নিকট রহিয়াছে এক হাজার দীনার বা ততোধিক। অতঃপর সে যাইয়া কোন নারীকে বিবাহ করিলে এবং উহাকে মহর দিলে যাহা তাহার মালকে অনেক কমাইয়া দিবে এবং উহাতে “বদলে কিতাবাত” আদায় করিতে যে অপারক হইবে, ফলে তাহার কর্তার দিকে ফিরিবে দাসরূপে। যাহার নিকট কোন মাল নাই, অথবা সে প্রবাসে যাইবে (ইতিমধ্যে) তাহার কিস্তি আদায়ের সময় উপস্থিত হইবে, অথচ সে অনুপস্থিত, এইরূপ করার ইখতিয়ার মুকাতাবের নাই এবং উহার উপর মুকাতাবাত সংঘটিত হয় নাই। এইসব ইখতিয়ার তাহার কর্তার হাতে, সে ইচ্ছা করিলে তাহাকে অনুমতি দিবে এই ব্যাপারে, আর ইচ্ছা করিলে সে ইহা হইতে বারণ করিবে।
Malik related to me that he heard Rabia ibn Abi Abd ar-Rahman and others mention that al-Furafisa ibn Umar al-Hanafi had a mukatab who offered to pay him all of his kitaba that he owed. Al-Furafisa refused to accept it and the mukatab went to Marwan ibn al-Hakam who was the amir of Madina and brought up the matter. Marwan summoned al-Furafisa and told him to accept. He refused. Marwan then ordered that the payment be taken from the mukatab and placed in the treasury. He said to the mukatab "Go, you are free." When al-Furafisa saw that, he took the money. Malik said, "What is done among us when a mukatab pays all the instalments he owes before their term, is that it is permitted to him. The master cannot refuse him that. That is because payment removes every condition from the mukatab as well as service and travel. The setting free of a man is not complete while he has any remaining slavery, and neither would his inviolability as a free man be complete and his testimony permitted and inheritance obliged and such things in that situation. His master must not make any stipulation of service on him after he has been set free." Malik said that it was permitted for a mukatab who became extremely ill and wanted to pay his master all his instalments because his heirs who were free would then inherit from him and he had no children with him in his kitaba, to do so, because by that he completed his inviolability as a free man, his testimony was permitted, and his admission of what he owed of debts to people was permitted. His bequest was permitted as well. His master could not refuse him that by saying, "He is escaping from me with his property

রেওয়ায়ত ১৪. মালিক (রহঃ) বলেনঃ এক ব্যক্তি নিজের ক্রীতদাসের সহিত মুকাতাব করিয়াছে, অতঃপর মুকাতাবের মৃত্যু হইয়াছে এবং রাখিয়া গিয়াছে তাহার উম্মে-ওয়ালাদ। আর তাহার কিতাবাতের কিছু অবশিষ্ট (অনাদায়ী) রহিয়াছে এবং সে (বদলে কিতাবাতের বাকী কিস্তি) যাহা তাহার জিম্মায় রহিয়াছে উহা পরিশোধ করা যায় এমন মালও রাখিয়া গিয়াছে। মালিক (রহঃ) বলেনঃ আযাদী লাভের পূর্বে যখন মুকাতাবের মৃত্যু হইয়াছে এবং সন্তানও রাখিয়া যায় নাই যাহারা “বদলে কিতাবাত”-এর বকেয়া পরিশোধ করিয়া নিজেরাও আযাদী লাভ করিত এবং (সাথে সাথে) তাহাদের পিতার “উম্মে-ওয়ালাদ”ও ইহার ফলে আযাদী লাভ করিত (কাজেই) মুকাতাবের “উম্মে-ওয়ালাদ” ক্রীতদাসী থাকিয়া যাইবে। মালিক (রহঃ) বলেনঃ (মুকাতাব তাহার গোলামকে আযাদ করিয়া দিয়াছে অথবা তাহার মালের কিছু অংশ সদকা করিয়া দিয়াছে এবং তাহার কর্তাকে সে উহা জানায় নাই (এই অবস্থাতে) মুকাতাব আযাদী লাভ করিয়াছে। মালিক (রহঃ) বলেনঃ ইহা তাহার পক্ষে কার্যকর করা হইবে, মুকাতাবের জন্য উহা হইতে রুজু করারও ইখতিয়ার থাকিবে না, পক্ষান্তরে যদি মুকাতাবের আযাদী লাভের পূর্বে কর্তা উহা জানিতে পারে এবং (জানার পর) সে উহা রদ করিয়া দেয় উহাকে চালু না করে তবে মুকাতাব আযাদ হইলে পর, মাল ও ক্রীতদাস তাহার হাতে থাকিলে তাহার জন্য গোলাম আযাদ করা অথবা সেই সদৃকা বাহির করা জরুরী নহে, কিন্তু ইহা স্বেচ্ছায় ও স্বতঃস্ফূর্তভাবে করিতে পারিবে।
Malik said, "The best of what I have heard about a mukatab who injures a man so that blood-money must be paid, is that if the mukatab can pay the blood-money for the injury with his kitaba, he does so, and it is against his kitaba. If he cannot do that, and he cannot pay his kitaba because he must pay the blood-money of that injury before the kitaba, and he cannot pay the blood-money of that injury, then his master has an option. If he prefers to pay the blood-money of that injury, he does so and keeps his slave and he becomes an owned slave. If he wishes to surrender the slave to the injured, he surrenders him. The master does not have to do more than surrender his slave." Malik spoke about people who were in a general kitaba and one of them caused an injury which entailed blood-money. He said, "If any of them does an injury involving blood-money, he and those who are with him in the kitaba are asked to pay all the blood-money of that injury. If they pay, they are confirmed in their kitaba. If they do not pay, and they are incapable then their master has an option. If he wishes, he can pay all the blood-money of that injury and all the slaves revert to him. If he wishes, he can surrender the one who did the injury alone and all the others revert to being his slaves since they could not pay the blood-money of the injury which their companion caused." Malik said, "The way of doing things about which there is no dispute among us, is that when a mukatab is injured in some way which entails blood-money or one of the mukatab's children who is written with him in the kitaba is injured, their blood-money is the blood-money of slaves of their value, and what is appointed to them as their blood-money is paid to the master who has the kitaba and he reckons that for the mukatab at the end of his kitaba and there is a reduction for the blood-money that the master has taken for the injury." Malik said, "The explanation of that is say, for example, he has written his kitaba for three thousand dirhams and the blood-money taken by the master for his injury is one thousand dirhams. When the mukatab has paid his master two thousand dirhams he is free. If what remains of his kitaba is one thousand dirhams and the blood-money for his injury is one thousand dirhams, he is free straightaway. If the blood-money of the injury is more than what remains of the kitaba, the master of the mukatab takes what remains of his kitaba and frees him. What remains after the payment of the kitaba belongs to the mukatab. One must not pay the mukatab any of the blood- money of his injury in case he might consume it and use it up. If he could not pay his kitaba completely he would then return to his master one eyed, with a hand cut off, or crippled in body. His master only wrote his kitaba against his property and earnings, and he did not write his kitaba so that he would take the blood-money for what happened to his child or to himself and use it up and consume it. One pays the blood-money of injuries to a mukatab and his children who are born in his kitaba, or their kitaba is written, to the master and he takes it into account for him at the end of his kitaba." Malik said, "The best of what is said about a man who buys the mukatab of a man is that if the man wrote the slave's kitaba for dinars or dirhams, he does not sell him unless it is for merchandise which is paid immediately and not deferred, because if it is deferred, it would be a debt for a debt. A debt for a debt is forbidden." He said, "If the master gives a mukatab his kitaba for certain merchandise of camels, cattle, sheep, or slaves, it is more correct that the buyer buy him for gold, silver, or different goods than the ones his master wrote the kitaba for, and that must be paid immediately, not deferred." Malik said, "The best of what I have heard about a mukatab when he is sold is that he is more entitled to buy his kitaba than the one who buys him if he can pay his master the price for which he was sold in cash. That is because his buying himself is his freedom, and freedom has priority over what bequests accompany it. If one of those who have written the kitaba for the mukatab sells his portion of him, so that a half, a third, a fourth, or whatever share of the mukatab is sold, the mukatab does not have the right of pre-emption in what is sold of him. That is because it is like the severance of a partner, and a partner can only make a settlement for a partner of the one who is mukatab with the permission of his partners because what is sold of him does not give him complete rights as a free man and his property is barred from him, and by buying part of himself, it is feared that he will become incapable of completing payment because of what he had to spend. That is not like the mukatab buying himself completely unless whoever has some of the kitaba remaining due to him gives him permission. If they give him permission, he is more entitled to what is sold of him." Malik said, "Selling one of the instalments of a mukatab is not halal. That is because it Is an uncertain transaction. If the mukatab cannot pay it, what he owes is nullified. If he dies or goes bankrupt and he owes debts to people, then the person who bought his instalment does not take any of his portion with the creditors. The person who buys one of the instalments of the mukatab is in the position of the master of the mukatab. The master of the mukatab does not have a share with the creditors of the mukatab for what he is owed of the kitaba of his slave. It is also like that with the kharaj, (a set amount deducted daily from the slave against his earnings), which accumulates for a master from the earnings of his slave. The creditors of his slave do not allow him a share for what has accumulated for him from those deductions." Malik said, "There is no harm in a mukatab paying off his kitaba with coin or merchandise other than the merchandise for which he wrote his kitaba if it is identical with it, on time (for the instalment) or delayed. " Malik said that if a mukatab died and left an umm walad and small children by her or by someone else and they could not work and it was feared that they would be unable to fulfil their kitaba, the umm walad of the father was sold if her price would pay all the kitaba for them, whether or not she was their mother. They were paid for and set free because their father did not forbid her sale if he feared that he would be unable to complete his kitaba. If her price would not pay for them and neither she nor they could work, they all reverted to being slaves of the master. Malik said, "What is done among us in the case of a person who buys the kitaba of a mukatab, and then the mukatab dies before he has paid his kitaba, is that the person who bought the kitaba inherits from him. If, rather than dying, the mukatab cannot pay, the buyer has his person. If the mukatab pays his kitaba to the person who bought him and he is freed, his wala' goes to the person who wrote the kitaba and the person who bought his kitaba does not have any of it." Malik related to me that he heard that Urwa ibn az-Zubayr and Sulayman ibn Yasar when asked whether the sons of a man, who had a kitaba written for himself and his children and then died, worked for the kitaba of their father or were slaves, said, "They work for the kitaba of their father and they have no reduction at all for the death of their father." Malik said, "If they are small and unable to work, one does not wait for them to grow up and they are slaves of their father's master unless the mukatab has left what will pay their instalments for them until they can work. If there is enough to pay for them in what he has left, that is paid for on their behalf and they are left in their condition until they can work, and then if they pay, they are free. If they cannot do it, they are slaves." Malik spoke about a mukatab who died and left property which was not enough to pay his kitaba, and he also left a child with him in his kitaba and an umm walad, and the umm walad wanted to work for them. He said, "The money is paid to her if she is trustworthy with it and strong enough to work. If she is not strong enough to work and not trustworthy with property, she is not given any of it and she and the children of the mukatab revert to being slaves of the master of the mukatab." Malik said, "If people are written together in one kitaba and there is no kinship between them, and some of them are incapable and others work until they are all set free, those who worked can claim from those who were unable, the portion of what they paid for them because some of them assumed the responsibility for others

حَدَّثَنِي مَالِكٌ، أَنَّهُ بَلَغَهُ أَنَّ سَعِيدَ بْنَ الْمُسَيَّبِ، سُئِلَ عَنْ مُكَاتَبٍ، كَانَ بَيْنَ رَجُلَيْنِ فَأَعْتَقَ أَحَدُهُمَا نَصِيبَهُ فَمَاتَ الْمُكَاتَبُ وَتَرَكَ مَالاً كَثِيرًا فَقَالَ يُؤَدَّى إِلَى الَّذِي تَمَاسَكَ بِكِتَابَتِهِ الَّذِي بَقِيَ لَهُ ثُمَّ يَقْتَسِمَانِ مَا بَقِيَ بِالسَّوِيَّةِ ‏.‏ قَالَ مَالِكٌ إِذَا كَاتَبَ الْمُكَاتَبُ فَعَتَقَ فَإِنَّمَا يَرِثُهُ أَوْلَى النَّاسِ بِمَنْ كَاتَبَهُ مِنَ الرِّجَالِ يَوْمَ تُوُفِّيَ الْمُكَاتَبُ مِنْ وَلَدٍ أَوْ عَصَبَةٍ ‏.‏ قَالَ وَهَذَا أَيْضًا فِي كُلِّ مَنْ أُعْتِقَ فَإِنَّمَا مِيرَاثُهُ لأَقْرَبِ النَّاسِ مِمَّنْ أَعْتَقَهُ مِنْ وَلَدٍ أَوْ عَصَبَةٍ مِنَ الرِّجَالِ يَوْمَ يَمُوتُ الْمُعْتَقُ بَعْدَ أَنْ يَعْتِقَ وَيَصِيرَ مَوْرُوثًا بِالْوَلاَءِ ‏.‏ قَالَ مَالِكٌ الإِخْوَةُ فِي الْكِتَابَةِ بِمَنْزِلَةِ الْوَلَدِ إِذَا كُوتِبُوا جَمِيعًا كِتَابَةً وَاحِدَةً إِذَا لَمْ يَكُنْ لأَحَدٍ مِنْهُمْ وَلَدٌ كَاتَبَ عَلَيْهِمْ أَوْ وُلِدُوا فِي كِتَابَتِهِ أَوْ كَاتَبَ عَلَيْهِمْ ثُمَّ هَلَكَ أَحَدُهُمْ وَتَرَكَ مَالاً أُدِّيَ عَنْهُمْ جَمِيعُ مَا عَلَيْهِمْ مِنْ كِتَابَتِهِمْ وَعَتَقُوا وَكَانَ فَضْلُ الْمَالِ بَعْدَ ذَلِكَ لِوَلَدِهِ دُونَ إِخْوَتِهِ ‏.‏
রেওয়ায়ত ১৩. মালিক (রহঃ) বলেনঃ ক্রীতদাসদের একদল যদি একই কিতাবাতে সংযুক্ত থাকে, তবে কিতাবাতে শামিল অন্যান্য সাথীর পরামর্শ ও সম্মতি ব্যতীত উহাদের একজনকে কর্তা আযাদী দিতে পারিবে না, আর উহারা যদি অল্প বয়সের হয়, তবে উহাদের পরামর্শ গ্রহণযোগ্য নহে এবং উহাদের পরামর্শ গ্রহণ করা বৈধ নহে। মালিক (রহঃ) বলেন, ইহা এইজন্য যে, কোন ব্যক্তি হয়ত সকলের পক্ষে চেষ্টা বা পরিশ্রম করিতে পারে এবং (চেষ্টা করিয়া) সকলের পক্ষ হইতে “বদলে কিতাবাত” পরিশোধ করিতে পারে, যেন সকলের আযাদী ইহার দ্বারা পূর্ণতা লাভ করে। আর যে ব্যক্তি সকলের পক্ষ হইতে “বদলে কিতাবাত” পরিশোধ করিবে এবং গোলামি হইতে উহাদের মুক্তি পাওয়া যাহার উপর নির্ভরশীল কর্তা সেই ব্যক্তিকে আযাদ করিয়া দিতেছে যেন অন্যান্য ক্রীতদাস অপারক হইয়া পড়ে (ফলে যেন উহারা গোলাম থাকিয়া যায়)। কর্তা এইরূপ করিয়া নিজের জন্য কিছু অতিরিক্ত সুবিধা আদায় করিতে প্রয়াসী। তাই যাহারা অবশিষ্ট রহিয়াছে উহাদের স্বার্থে এইরূপ করা জায়েয হইবে না। রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম ইরশাদ করিয়াছেন, ইসলামে কাহারো ক্ষতি সাধন বৈধ নহে। (এমনকি) প্রতিশোধমূলক কাহারো ক্ষতি সাধনও বৈধ নহে। (অন্যদেরকে ক্রীতদাস রাখার জন্য দলের একজনকে আযাদ করিয়া দেওয়া) ইহাতে অন্যদের উপর জঘন্য ধরনের ক্ষতি করা হইল। মালিক (রহঃ) বলেনঃ কয়েকজন ক্রীতদাস একত্রে কিতাবাত করিয়াছে (উহাদের মধ্য হইতে) অশীতিপর বৃদ্ধ এবং বালককে আযাদ করিয়া দেওয়ার ইখতিয়ার কর্তার রহিয়াছে। যাহারা কিছু দেওয়ার ক্ষমতা রাখে না এবং উহাদের কিতাবাতের মূল্য আদায়ের ব্যাপারে কোন সহযোগী বা সাহায্যকারীও উহাদের নাই, তবে (এইরূপ ব্যক্তিকে) আযাদ করা কর্তার জন্য জায়েয আছে।
Malik related to me that he had heard that Said ibn al-Musayyab was asked about a mukatab who was shared between two men. One of them freed his portion and then the mukatab died and left a lot of money. Said replied, "The one who kept his kitaba is paid what remains due to him, and then they divide what is left between them both equally." Malik said, "When a mukatab who fulfils his kitaba and becomes free dies, he is inherited from by the people who wrote his kitaba and their children and paternal relations - whoever is most deserving." He said, "This is also for whoever is set free when he dies after being set free - his inheritance is for the nearest people to him of children or paternal relations who inherit by means of the wala'." Malik said, "Brothers, written together in the same kitaba, are in the same position as children to each other when none of them have children written in the kitaba or born in the kitaba. When one of them dies and leaves property, he pays for them all that is against them of their kitaba and sets them free. The money left over after that goes to his children rather than his brothers

حَدَّثَنِي مَالِكٌ، أَنَّهُ بَلَغَهُ أَنَّ أُمَّ سَلَمَةَ، زَوْجَ النَّبِيِّ صلى الله عليه وسلم كَانَتْ تُقَاطِعُ مُكَاتَبِيهَا بِالذَّهَبِ وَالْوَرِقِ ‏.‏ قَالَ مَالِكٌ الأَمْرُ الْمُجْتَمَعُ عَلَيْهِ عِنْدَنَا فِي الْمَكَاتَبِ يَكُونُ بَيْنَ الشَّرِيكَيْنِ فَإِنَّهُ لاَ يَجُوزُ لأَحَدِهِمَا أَنْ يُقَاطِعَهُ عَلَى حِصَّتِهِ إِلاَّ بِإِذْنِ شَرِيكِهِ وَذَلِكَ أَنَّ الْعَبْدَ وَمَالَهُ بَيْنَهُمَا فَلاَ يَجُوزُ لأَحَدِهِمَا أَنْ يَأْخُذَ شَيْئًا مِنْ مَالِهِ إِلاَّ بِإِذْنِ شَرِيكِهِ وَلَوْ قَاطَعَهُ أَحَدُهُمَا دُونَ صَاحِبِهِ ثُمَّ حَازَ ذَلِكَ ثُمَّ مَاتَ الْمُكَاتَبُ وَلَهُ مَالٌ أَوْ عَجَزَ لَمْ يَكُنْ لِمَنْ قَاطَعَهُ شَىْءٌ مِنْ مَالِهِ وَلَمْ يَكُنْ لَهُ أَنْ يَرُدَّ مَا قَاطَعَهُ عَلَيْهِ وَيَرْجِعَ حَقُّهُ فِي رَقَبَتِهِ وَلَكِنْ مَنْ قَاطَعَ مُكَاتَبًا بِإِذْنِ شَرِيكِهِ ثُمَّ عَجَزَ الْمُكَاتَبُ فَإِنْ أَحَبَّ الَّذِي قَاطَعَهُ أَنْ يَرُدَّ الَّذِي أَخَذَ مِنْهُ مِنَ الْقَطَاعَةِ وَيَكُونُ عَلَى نَصِيبِهِ مِنْ رَقَبَةِ الْمُكَاتَبِ كَانَ ذَلِكَ لَهُ وَإِنْ مَاتَ الْمُكَاتَبُ وَتَرَكَ مَالاً اسْتَوْفَى الَّذِي بَقِيَتْ لَهُ الْكِتَابَةُ حَقَّهُ الَّذِي بَقِيَ لَهُ عَلَى الْمُكَاتَبِ مِنْ مَالِهِ ثُمَّ كَانَ مَا بَقِيَ مِنْ مَالِ الْمُكَاتَبِ بَيْنَ الَّذِي قَاطَعَهُ وَبَيْنَ شَرِيكِهِ عَلَى قَدْرِ حِصَصِهِمَا فِي الْمُكَاتَبِ وَإِنْ كَانَ أَحَدُهُمَا قَاطَعَهُ وَتَمَاسَكَ صَاحِبُهُ بِالْكِتَابَةِ ثُمَّ عَجَزَ الْمُكَاتَبُ قِيلَ لِلَّذِي قَاطَعَهُ إِنْ شِئْتَ أَنْ تَرُدَّ عَلَى صَاحِبِكَ نِصْفَ الَّذِي أَخَذْتَ وَيَكُونُ الْعَبْدُ بَيْنَكُمَا شَطْرَيْنِ وَإِنْ أَبَيْتَ فَجَمِيعُ الْعَبْدِ لِلَّذِي تَمَسَّكَ بِالرِّقِّ خَالِصًا ‏.‏ قَالَ مَالِكٌ فِي الْمُكَاتَبِ يَكُونُ بَيْنَ الرَّجُلَيْنِ فَيُقَاطِعُهُ أَحَدُهُمَا بِإِذْنِ صَاحِبِهِ ثُمَّ يَقْتَضِي الَّذِي تَمَسَّكَ بِالرِّقِّ مِثْلَ مَا قَاطَعَ عَلَيْهِ صَاحِبُهُ أَوْ أَكْثَرَ مِنْ ذَلِكَ ثُمَّ يَعْجِزُ الْمُكَاتَبُ ‏.‏ قَالَ مَالِكٌ فَهُوَ بَيْنَهُمَا لأَنَّهُ إِنَّمَا اقْتَضَى الَّذِي لَهُ عَلَيْهِ وَإِنِ اقْتَضَى أَقَلَّ مِمَّا أَخَذَ الَّذِي قَاطَعَهُ ثُمَّ عَجَزَ الْمُكَاتَبُ فَأَحَبَّ الَّذِي قَاطَعَهُ أَنَّ يَرُدَّ عَلَى صَاحِبِهِ نِصْفَ مَا تَفَضَّلَهُ بِهِ وَيَكُونُ الْعَبْدُ بَيْنَهُمَا نِصْفَيْنِ فَذَلِكَ لَهُ وَإِنْ أَبَى فَجَمِيعُ الْعَبْدِ لِلَّذِي لَمْ يُقَاطِعْهُ وَإِنْ مَاتَ الْمُكَاتَبُ وَتَرَكَ مَالاً فَأَحَبَّ الَّذِي قَاطَعَهُ أَنْ يَرُدَّ عَلَى صَاحِبِهِ نِصْفَ مَا تَفَضَّلَهُ بِهِ وَيَكُونُ الْمِيرَاثُ بَيْنَهُمَا فَذَلِكَ لَهُ وَإِنْ كَانَ الَّذِي تَمَسَّكَ بِالْكِتَابَةِ قَدْ أَخَذَ مِثْلَ مَا قَاطَعَ عَلَيْهِ شَرِيكُهُ أَوْ أَفْضَلَ فَالْمِيرَاثُ بَيْنَهُمَا بِقَدْرِ مِلْكِهِمَا لأَنَّهُ إِنَّمَا أَخَذَ حَقَّهُ ‏.‏ قَالَ مَالِكٌ فِي الْمُكَاتَبِ يَكُونُ بَيْنَ الرَّجُلَيْنِ فَيُقَاطِعُ أَحَدُهُمَا عَلَى نِصْفِ حَقِّهُ بِإِذْنِ صَاحِبِهِ ثُمَّ يَقْبِضُ الَّذِي تَمَسَّكَ بِالرِّقِّ أَقَلَّ مِمَّا قَاطَعَ عَلَيْهِ صَاحِبُهُ ثُمَّ يَعْجِزُ الْمُكَاتَبُ ‏.‏ قَالَ مَالِكٌ إِنْ أَحَبَّ الَّذِي قَاطَعَ الْعَبْدَ أَنْ يَرُدَّ عَلَى صَاحِبِهِ نِصْفَ مَا تَفَضَّلَهُ بِهِ كَانَ الْعَبْدُ بَيْنَهُمَا شَطْرَيْنِ وَإِنْ أَبَى أَنْ يَرُدَّ فَلِلَّذِي تَمَسَّكَ بِالرِّقِّ حِصَّةُ صَاحِبِهِ الَّذِي كَانَ قَاطَعَ عَلَيْهِ الْمُكَاتَبَ ‏.‏ قَالَ مَالِكٌ وَتَفْسِيرُ ذَلِكَ أَنَّ الْعَبْدَ يَكُونُ بَيْنَهُمَا شَطْرَيْنِ فَيُكَاتِبَانِهِ جَمِيعًا ثُمَّ يُقَاطِعُ أَحَدُهُمَا الْمُكَاتَبَ عَلَى نِصْفِ حَقِّهِ بِإِذْنِ صَاحِبِهِ وَذَلِكَ الرُّبُعُ مِنْ جَمِيعِ الْعَبْدِ ثُمَّ يَعْجِزُ الْمُكَاتَبُ فَيُقَالُ لِلَّذِي قَاطَعَهُ إِنْ شِئْتَ فَارْدُدْ عَلَى صَاحِبِكَ نِصْفَ مَا فَضَلْتَهُ بِهِ وَيَكُونُ الْعَبْدُ بَيْنَكُمَا شَطْرَيْنِ ‏.‏ وَإِنْ أَبَى كَانَ لِلَّذِي تَمَسَّكَ بِالْكِتَابَةِ رُبُعُ صَاحِبِهِ الَّذِي قَاطَعَ الْمُكَاتَبَ عَلَيْهِ خَالِصًا وَكَانَ لَهُ نِصْفُ الْعَبْدِ فَذَلِكَ ثَلاَثَةُ أَرْبَاعِ الْعَبْدِ وَكَانَ لِلَّذِي قَاطَعَ رُبُعُ الْعَبْدِ لأَنَّهُ أَبَى أَنْ يَرُدَّ ثَمَنَ رُبُعِهِ الَّذِي قَاطَعَ عَلَيْهِ ‏.‏ قَالَ مَالِكٌ فِي الْمُكَاتَبِ يُقَاطِعُهُ سَيِّدُهُ فَيَعْتِقُ وَيَكْتُبُ عَلَيْهِ مَا بَقِيَ مِنْ قَطَاعَتِهِ دَيْنًا عَلَيْهِ ثُمَّ يَمُوتُ الْمُكَاتَبُ وَعَلَيْهِ دَيْنٌ لِلنَّاسِ ‏.‏ قَالَ مَالِكٌ فَإِنَّ سَيِّدَهُ لاَ يُحَاصُّ غُرَمَاءَهُ بِالَّذِي عَلَيْهِ مِنْ قَطَاعَتِهِ وَلِغُرَمَائِهِ أَنْ يُبَدَّءُوا عَلَيْهِ ‏.‏ قَالَ مَالِكٌ لَيْسَ لِلْمُكَاتَبِ أَنْ يُقَاطِعَ سَيِّدَهُ إِذَا كَانَ عَلَيْهِ دَيْنٌ لِلنَّاسِ فَيَعْتِقُ وَيَصِيرُ لاَ شَىْءَ لَهُ لأَنَّ أَهْلَ الدَّيْنِ أَحَقُّ بِمَالِهِ مِنْ سَيِّدِهِ فَلَيْسَ ذَلِكَ بِجَائِزٍ لَهُ ‏.‏ قَالَ مَالِكٌ الأَمْرُ عِنْدَنَا فِي الرَّجُلِ يُكَاتِبُ عَبْدَهُ ثُمَّ يُقَاطِعُهُ بِالذَّهَبِ فَيَضَعُ عَنْهُ مِمَّا عَلَيْهِ مِنَ الْكِتَابَةِ عَلَى أَنْ يُعَجِّلَ لَهُ مَا قَاطَعَهُ عَلَيْهِ أَنَّهُ لَيْسَ بِذَلِكَ بَأْسٌ وَإِنَّمَا كَرِهَ ذَلِكَ مَنْ كَرِهَهُ لأَنَّهُ أَنْزَلَهُ بِمَنْزِلَةِ الدَّيْنِ يَكُونُ لِلرَّجُلِ عَلَى الرَّجُلِ إِلَى أَجَلٍ فَيَضَعُ عَنْهُ وَيَنْقُدُهُ وَلَيْسَ هَذَا مِثْلَ الدَّيْنِ إِنَّمَا كَانَتْ قَطَاعَةُ الْمُكَاتَبِ سَيِّدَهُ عَلَى أَنْ يُعْطِيَهُ مَالاً فِي أَنْ يَتَعَجَّلَ الْعِتْقَ فَيَجِبُ لَهُ الْمِيرَاثُ وَالشَّهَادَةُ وَالْحُدُودُ وَتَثْبُتُ لَهُ حُرْمَةُ الْعَتَاقَةِ وَلَمْ يَشْتَرِ دَرَاهِمَ بِدَرَاهِمَ وَلاَ ذَهَبًا بِذَهَبٍ وَإِنَّمَا مَثَلُ ذَلِكَ مَثَلُ رَجُلٍ قَالَ لِغُلاَمِهِ ائْتِنِي بِكَذَا وَكَذَا دِينَارًا وَأَنْتَ حُرٌّ فَوَضَعَ عَنْهُ مِنْ ذَلِكَ فَقَالَ إِنْ جِئْتَنِي بِأَقَلَّ مِنْ ذَلِكَ فَأَنْتَ حُرٌّ ‏.‏ فَلَيْسَ هَذَا دَيْنًا ثَابِتًا وَلَوْ كَانَ دَيْنًا ثَابِتًا لَحَاصَّ بِهِ السَّيِّدُ غُرَمَاءَ الْمُكَاتَبِ إِذَا مَاتَ أَوْ أَفْلَسَ فَدَخَلَ مَعَهُمْ فِي مَالِ مُكَاتَبِهِ ‏.‏
রেওয়ায়ত ৫. মালিক (রহঃ) বলেনঃ তাহার নিকট রেওয়ায়ত পৌছিয়াছে যে, নবী করীম সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম-এর সহধর্মিণী উম্মে সালমা (রাঃ) স্বর্ণ এবং রৌপ্যের বিনিময়ে তাহার মুকাতাবদের সঙ্গে মুকাতা'আ (مقاطعة কমানোর চুক্তি) করিতেন। মালিক (রহঃ) বলেনঃ আমাদের নিকট সর্বসম্মত সিদ্ধান্ত হইল এই– যেই মুকাতাব দুই শরীকের মালিকানাতে রহিয়াছে, অপর শরীকের অনুমতি ছাড়া এক শরীকের জন্য তাহার হিস্সাতে মুকাতা'আ করা বৈধ নহে। ইহা এইজন্য যে, ক্রীতদাস এবং তাহার মাল উভয়ের মধ্যে মিলিত, কাজেই তাহাদের একজনের জন্য উহার মাল হইতে কিছু অংশ গ্রহণ করা জায়েয নহে, কিন্তু অপর শরীক যদি অনুমতি দেয় (তবে বৈধ হইবে)। আর যদি উহাদের একজন মুকাতাবের সহিত মুকাতা'আ (বদল-এ কিতাবাত হইতে কমাইবার চুক্তি) করিয়াছে অপর শরীক ছাড়া, অতঃপর উহা সে গ্রহণ করিয়াছে। তারপর মুকাতাবের মৃত্যু হইয়াছে এবং উহার নিকট মাল রহিয়াছে অথবা সে (অর্থ আদায়ে) অক্ষম হইয়া গিয়াছে, তবে যে (শরীক) মুকাতা'আ করিয়াছে সে মুকাতাবের মাল হইতে কিছুই পাইবে না। আর বিনিময়ে অর্থের যে অংশ সে মুকাতা'আ করিয়াছে অর্থাৎ কমাইয়া দিয়া সে উহা ফেরত দিয়া মুকাতাবের রাকাবা (গদান অর্থাৎ দাসত্বের অধিকারী হওয়া)-তে তাহার (সাবেক) হকের দিকে রুজু করার ইখতিয়ারও তাহার থাকিবে না। পক্ষান্তরে যে ব্যক্তি তাহার শরীকের অনুমতি লইয়া মুকাতাবের সহিত মুকাতা'আ করিয়াছে, অতঃপর মুকাতাব অপারক হইয়াছে, তবে যে মুকাতা'আঃ (কমাইবার চুক্তি) করিয়াছে সে মুকাতা'আঃ অনুযায়ী যে অর্থ মুকাতাব হইতে গ্রহণ করিয়াছে সে অর্থ ফেরত দিয়া পুনরায় মুকাতাবের মধ্যে তাহার অংশের অধিকারী হইতে পছন্দ করিলে ইহা তাহার জন্য বৈধ হইবে। আর যদি মুকাতাব মাল রাখিয়া মারা যায় তবে যাহার কিতাবাত অবশিষ্ট রহিয়াছে (অর্থাৎ যে মুকাতা'আ করে নাই সে) মুকাতাব-এর উপর তাহার যে হক রহিয়াছে তাহা মুকাতাবের মাল হইতে পূর্ণভাবে উশুল করবে। অতঃপর মুকাতাবের যে মাল অবশিষ্ট থাকে উহা যে মুকাতা'আ করিয়াছে তাহার এবং তাহার অপর শরীকের মধ্যে বন্টন করা হইবে মুকাতাবের উভয়ের মধ্যে হিসসা অনুযায়ী। আর যদি দুই জনের এক জন মুকাতাবের সহিত মুকাতা'আ করিয়াছে, অন্য শরীক তাহার সাথী কিতাবাতের উপর স্থির করিয়াছে, অতঃপর মুকাতাব অর্থ আদায়ে অপারক হইয়াছে, তবে যে মুকাতা'আ করিয়াছে তাহাকে বলা হইবে যে, আপনি ইচ্ছা করিলে যাহা আপনি গ্রহণ করিয়াছেন উহার অর্ধেক আপনার সাথীকে দিয়া দিতে পারেন, গোলাম আপনাদের উভয়ের মধ্যে থাকিবে অর্ধেক অর্ধেক। আর যদি আপনি ইহা অস্বীকার করেন তবে গোলাম সম্পূর্ণ সেই শরীকের হইবে, যে শরীক মুকাতা'আ না করিয়া মুকাতাবকে যেমন ছিল তেমনি রাখিয়া দিয়াছে। মালিক (রহঃ) বলেনঃ যে মুকাতাব দুই ব্যক্তির শরীকানাতে রহিয়াছে, তাহাদের একজন তাহার সাথীর (শরীক) অনুমতি লইয়া মুকাতাবের সহিত মুকাতা'আ করিয়াছে, অতঃপর যে শরীক দাস রাখিয়া দিয়াছে সে গ্রহণ করিল (মুকাতাব হইতে) ততটুকু যতটুকুর উপর তাহার সাথী শরীক মুকাতা'আ করিয়াছে অথবা ততোধিক। তারপর মুকাতাব অক্ষম হইল, মালিক (রহঃ) বলেনঃ গোলাম তাহাদের উভয়ের মধ্যে থাকিবে। কারণ সে মুকাতাবের উপর তাহার যে হক রহিয়াছে উহা গ্রহণ করিয়াছে, [কাজেই মুকাতা'আ যে করে নাই সে, মুকাতা'আ যে করিয়াছে তাহার নিকট হইতে কিছুই পাইবে না]। আর যে মুকাতা'আ করে নাই সে যদি মুকাতা'আকারী অপেক্ষা কম গ্রহণ করিয়া থাকে, অতঃপর মুকাতাব অপারক হইয়া পড়ে, আর যে মুকাতা'আ করিয়াছে সে যাহা অতিরিক্ত পাইয়াছে উহা হইতে তাহার সাথী (শরীক)-কে অর্ধেক ফিরাইয়া দেওয়াকে পছন্দ করে, ইহাতে গোলাম উভয়ের মধ্যে হইবে অর্ধেক অর্ধেক। তবে তাহার জন্য ইহার ইখতিয়ার রহিয়াছে, আর সে যদি ইহা অস্বীকার করে তবে মুকাতা'আঃ যে (শরীক) করে নাই গোলাম সম্পূর্ণ সে শরীকের জন্য হইবে। আর যদি মুকাতাবের মৃত্যু হয় এবং সে মাল রাখিয়া যায় এবং যে (শরীক) মুকাতা'আঃ করিয়াছে সে যাহা বেশি পাইয়াছে ইহা হইতে তাহার সাথী (শরীক)-কে অর্ধেক ফিরাইয়া দিতে পছন্দ করে তবে মীরাস তাহদের উভয়ের মধ্যে মুশতারাক বা মিলিত হইবে, তবে ইহা করিবার ইখতিয়ার রহিয়াছে। আর যে মুকাতা'আঃ করে নাই কিতাবাতকে বহাল রাখিয়াছে সে যদি তাহার শরীক মুকাতা'আকারী যতটুকুর উপর মুকাতা'আ করিয়াছে ততটুকু গ্রহণ করে বা তাহার চাইতে বেশি। তবে মীরাস তাহাদের উভয়ের মধ্যে বন্টন করা হইবে। কারণ সে তাহার প্রাপ্য গ্রহণ করিয়াছে। মালিক (রহঃ) বলেনঃ যে মুকাতাব দুই ব্যক্তির মধ্যে (মিলিত মালিকানায়) রহিয়াছে। অতঃপর তাহাদের একজন তাহার অর্ধেক হকের উপর তাহার সাথীর অনুমতি লইয়া মুকাতা'আ করিয়াছে। অতঃপর যে শরীক দাসত্ব বহাল রাখার উপর অটল রহিয়াছে সে তাহার সাথী যতটুকুর উপর মুকাতা'আ করিয়াছে ততটুকু হইতে কম (অর্থ) গ্রহণ করিয়াছে। তারপর গোলাম হইয়াছে অপারক। মালিক (রহঃ) বলেনঃ যে শরীক গোলামের সহিত মুকাতা'আ করিয়াছে সে যাহা অতিরিক্ত লইয়াছে উহার অর্ধেক যদি তাহার সাথী (শরীক)-কে ফিরাইয়া দেওয়া ভাল মনে করে তবে গোলাম তাহদের উভয়ের মধ্যে সমভাবে বহাল থাকিবে। আর যদি ফিরাইয়া দিতে অস্বীকার করে তবে মুকাতাবের সহিত তাহার যে সাথী (শরীক) মুকাতা’আত করিয়াছে তাহার হিসসা পাইবে দাসত্বকে যে বহাল রাখিয়াছে সে। মালিক (রহঃ) বলেনঃ ইহার ব্যাখ্যা হইতেছে এই, (দৃষ্টান্তস্বরূপ) ক্রীতদাস দুই কর্তার মালিকানায় রহিয়াছে অর্ধেক অর্ধেক ভাগে। তাহারা উভয়ে উহার সহিত মুকাতা'আ করিয়াছে। অতঃপর তাহাদের একজন তাহার হকের অর্ধেকের উপর মুকাতাবের সহিত মুকাতা'আঃ করিয়াছে সাথীর অনুমতি লইয়া আর এই অংশ হইতেছে ক্রীতদাসের পূর্ণ মূল্যের এক-চতুর্থাংশ। অতঃপর মুকাতাব অপারক হইলে (এই অবস্থায়) মুকাতা'আকারী শরীককে বলা হইবে, তুমি যদি ইচ্ছা কর যাহা তুমি অতিরিক্ত গ্রহণ করিয়াছ মুকাতা'আ দ্বারা উহার অর্ধেক তোমার সাথীকে ফিরাইয়া দাও, গোলাম তোমাদের উভয়ের মধ্যে থাকিবে দুই ভাগে (অর্ধেক অর্ধেক)। আর সে ইহা না মানিলে তবে যে শরীক কিতাবাতকে ধারণ করিয়া রাখিয়াছে (অর্থাৎ কিতাবাত চুক্তির উপর বহাল রহিয়াছে, মুকাতা'আ করে নাই) সে তাহার সাথীর যেই অংশের উপর মুকাতা'আ করে নাই, সে তাহার সাথীর যেই অংশের উপর মুকাতাবের সঙ্গে মুকাতা'আ করিয়াছে উহার এক-চতুর্থাংশ পাইবে, (পূর্বে) তাহার (মালিকানায়) ছিল গোলামের অর্ধেকাংশ, এইরূপে তাহার (মালিকানায়) আসিয়া যাইবে তিন-চতুর্থাংশ, আর মুকাতা'আকারী শরীকের থাকিবে গোলামের এক-চতুর্থাংশ। কারণ সে, যেই চতুর্থাংশের উপর মুকাতা'আ করিয়াছিল উহার মূল্য ফেরত দিতে অস্বীকার করিয়াছে। মালিক (রহঃ) বলেনঃ যে মুকাতাবের সহিত তাহার কর্তা মুকাতা'আ করিয়াছে এবং উহাকে আযাদ করিয়া দিয়াছে এবং কিতা'আ বাবদ অবশিষ্ট যাহা অনাদায়ী রহিয়াছে উহা ক্রীতদাসের উপর ঋণ স্বরূপ লিখিয়া দিয়াছে, তারপর মুকাতাবের মৃত্যু হইয়াছে এবং তাহার উপর আরও লোকের ঋণ রহিয়াছে। মালিক (রহঃ) বলেনঃ ক্রীতদাসের উপর কিতা’আত বাবদ কর্তা যাহা পাইবে উহার জন্য তাহার কর্তা অন্যান্য ঋণদাতাদের সঙ্গে শরীক হইয়া অংশ ভাগ করিতে পারবে না, বরং ঋণদাতাগণ আগে তাহাদের হক উশুল করিয়া লইবে সেই অধিকার তাহাদের রহিয়াছে। মালিক (রহঃ) বলেনঃ মুকাতাবের উপর লোকের ঋণ থাকিলে তাহার জন্য কর্তার সহিত মুকাতা'আ করা ঠিক নহে, (এইরূপ করিলে) সে আযাদ হইয়া যাইবে, অথচ তাহার কোন মাল নাই। (কারণ তাহার যাবতীয় মাল ঋণদাতাদের প্রাপ্য হইয়াছে)। কারণ ঋণদাতাগণ তাহার কর্তা অপেক্ষা তাহার মালের বেশি হকদার, তাই এইরূপ করা মুকাতাবের জন্য জায়েয নহে। মালিক (রহঃ) বলেনঃ আমাদের নিকট মাসআলা এই, যে ব্যক্তি গোলামের সহিত মুকাতাবাত করিয়াছে, অতঃপর স্বর্ণের বিনিময়ে উহার সহিত মুকাতা'আ করিল এবং ক্রীতদাসের জিম্মায় যে "বদল-এ কিতাবাত" (আদায়যোগ্য অর্থ) রহিয়াছে তাহা মাফ করিয়া দিল এই শর্তে যে, যে স্বর্ণের উপর মুকাতা'আ হইয়াছে উহা সে কর্তাকে নগদ পরিশোধ করিবে এইরূপ করাতে কোন দোষ নাই। ইহাকে যিনি মাকরূহ বলিয়াছেন, তিনি এই জন্য মাকরূহ বলিয়াছেন যে, তিনি ইহাকে ঋণের মতো গণ্য করিয়াছেন। এক ব্যক্তির উপর অন্য ব্যক্তির নির্দিষ্ট সময়ে আদায়যোগ্য ঋণ রহিয়াছে, ঋণদাতা ঋণের কিছু অংশ মাফ করিয়া দিল নগদ অর্থ লইয়া (ইহা জায়েয নহে, কাজেই মুকাতা'আতেও নগদ অর্থের শর্তে কিছু মাফ করিয়া দিলে উহা জায়েয হইবে না)। মালিক (রহঃ) বলেনঃ ইহা ঋণের মতো নহে, কারণ কর্তার সহিত মুকাতাবের কিতা’আত করার উদ্দেশ্য হইতেছে, কর্তাকে কিছু মাল সে দিবে যেন সে আযাদী ত্বরান্বিত করে। ফলে তাহার জন্য মীরাস এবং সাক্ষ্যদান ও হুদূদের অধিকার ওয়াজিব হইবে এবং সাব্যস্ত হইবে তাহার জন্য আযাদী ও সম্মান। সে কোন দিরহামের বিনিময়ে দিরহাম বা স্বর্ণের বিনিময়ে স্বর্ণ খরিদ করে নাই। ইহার দৃষ্টান্ত এইরূপ-যেমন এক ব্যক্তি তাহার গোলামকে বলিল-তুমি এত দীনার যদি নিয়া আস, তবে তুমি আযাদ, তারপর ইহা হইতে কিছু কমাইয়া দিল এবং বলিল, আমার নিকট নির্ধারিত অর্থ হইতে কিছু কম উপস্থিত করিলেও তুমি আযাদ। ইহা গোলামের জিম্মায় জরুরী হইয়াছে এমন কোন ঋণ নহে, যদি উহা (মুকাতা'আ অর্থ) ঋণ হইত তবে মুকাতাব মারা গেলে অথবা মুফসিল (রিক্ত হস্ত) হইলে কর্তা অন্যান্য ঋণদাতার সহিত মিলিত হইয়া তাহার অংশ আদায় করিত এবং উহাদের সহিত “বদল-এ কিতাবাত” আদায়ের ব্যাপারে শামিল হইয়া যাইত।
Malik said, "The generally agreed on way of doing things among us is that when slaves write their kitaba together in one kitaba, and some are responsible for others, and they are not reduced anything by the death of one of the responsible ones, and then one of them says, 'I can't do it,' and gives up, his companions can use him in whatever work he can do and they help each other with that in their kitaba until they are freed, if they are freed, or remain slaves if they remain slaves." Malik said, "The generally agreed on way of doing things among us is that when a master gives a slave his kitaba, it is not permitted for the master to let anyone assume the responsibility for the kitaba of his slave if the slave dies or is incapable. This is not part of the sunna of the muslims. That is because when a man assumes responsibility to the master of a mukatab for what the mukatab owes of his kitaba, and then the master of the mukatab pursues that from the one who assumes the responsibility, he takes his money falsely. It is not as if he is buying the mukatab, so that what he gives is part of the price of something that is his, and neither is the mukatab being freed so that the price established for him buys his inviolability as a free man. If the mukatab is unable to meet the payments he reverts to his master and is his slave. That is because kitaba is not a fixed debt which can be assumed by the master of the mukatab. It is something which, when it is paid by the mukatab, sets him free. If the mukatab dies and has a debt, his master is not one of the creditors for what remains unpaid of the kitaba. The creditors have precedence over the master. If the mukatab cannot meet the payments, and he owes debts to people, he reverts to being a slave owned by his master and the debts to the people are the liability of the mukatab. The creditors do not enter with the master into any share of the price of his person." Malik said, "When people are written together in one kitaba and there is no kinship between them by which they inherit from each other, and some of them are responsible for others, then none of them are freed before the others until all the kitaba has been paid. If one of them dies and leaves property and it is more than all of what is against them, it pays all that is against them . The excess of the property goes to the master, and none of those who have been written in the kitaba with the deceased have any of the excess. The master's claims are overshadowed by their claims for the portions which remain against them of the kitaba which can be fulfilled from the property of the deceased, because the deceased had assumed their responsibility and they must use his property to pay for their freedom. If the deceased mukatab has a free child not born in kitaba and who was not written in the kitaba, it does not inherit from him because the mukatab was not freed until he died." Malik related to me that he heard that Umm Salama, the wife of the Prophet, may Allah bless him and grant him peace, made a settlement with her mukatab for an agreed amount of gold and silver. Malik said, "The generally agreed on way of doing things among us in the case of a mukatab who is shared by two partners, is that one of them cannot make a settlement with him for an agreed price according to his portion without the consent of his partner. That is because the slave and his property are owned by both of them, and so one of them is not permitted to take any of the property except with the consent of his partner. If one of them settled with the mukatab and his partner did not, and he took the agreed price, and then the mukatab died while he had property or was unable to pay, the one who settled would not have anything of the mukatab's property and he could not return that for which he made settlement so that his right to the slave's person would return to him. However, when someone settles with a mukatab with the permission of his partner and then the mukatab is unable to pay, it is preferable that the one who broke with him return what he has taken from the mukatab for the severance and he can have back his portion of the mukatab. He can do that. If the mukatab dies and leaves property, the partner who has kept hold of the kitaba is paid in full the amount of the kitaba which remains to him against the mukatab from the mukatab's property. Then what remains of property of the mukatab is between the partner who broke with him and his partner, according to their shares in the mukatab. If one of the partners breaks off with him and the other keeps the kitaba, and the mukatab is unable to pay, it is said to the partner who settled with him, 'If you wish to give your partner half of what you took so the slave is divided between you, then do so. If you refuse, then all of the slave belongs to the one who held on to possession of the slave.' " Malik spoke about a mukatab who was shared between two men and one of them made a settlement with him with the permission of his partner. Then the one who retained possession of the slave demanded the like of that for which his partner had settled or more than that and the mukatab could not pay it. He said, "The mukatab is shared between them because the man has only demanded what is owed to him. If he demands less than what the one who settled with him took and the mukatab can not manage that, and the one who settled with him prefers to return to his partner half of what he took so the slave is divided in halves between them, he can do that. If he refuses then all of the slave belongs to the one who did not settle with him. If the mukatab dies and leaves property, and the one who settled with him prefers to return to his companion half of what he has taken so the inheritance is divided between them, he can do that. If the one who has kept the kitaba takes the like of what the one who has settled with him took, or more, the inheritance is between them according to their shares in the slave because he is only taking his right." Malik spoke about a mukatab who was shared between two men and one of them made a settlement with him for half of what was due to him with the permission of his partner, and then the one who retained possession of the slave took less than what his partner settled with him for and the mukatab was unable to pay. He said, "If the one who made a settlement with the slave prefers to return half of what he was awarded to his partner, the slave is divided between them. If he refuses to return it, the one who retained possession has the portion of the share for which his partner made a settlement with the mukatab." Malik said, "The explanation of that is that the slave is divided in two halves between them. They write him a kitaba together and then one of them makes a settlement with the mukatab for half his due with the permission of his partner. That is a fourth of all the slave. Then the mukatab is unable to continue, so it is said to the one who settled with him, 'If you wish, return to your partner half of what you were awarded and the slave is divided equally between you.' If he refuses, the one who held to the kitaba takes in full the fourth of his partner for which he made settlement with the mukatab. He had half the slave, so that now gives him three-fourths of the slave. The one who broke off has a fourth of the slave because he refused to return the equivalent of the fourth share for which he settled." Malik spoke about a mukatab whose master made a settlement with him and set him free and what remained of his severance was written against him as debt, then the mukatab died and people had debts against him. He said, "His master does not share with the creditors because of what he is owed from the severance. The creditors begin first." Malik said, "A mukatab cannot break with his master when he owes debts to people. He would be set free and have nothing because the people who hold the debts are more entitled to his property than his master. That is not permitted for him." Malik said, "According to the way things are done among us, there is no harm if a man gives a kitaba to his slave and settles with him for gold and reduces what he is owed of the kitaba provided that only the gold is paid immediately. Whoever disapproves of that does so because he puts it in the category of a debt which a man has against another man for a set term. He gives him a reduction and he pays it immediately. This is not like that debt. The breaking of the mukatab with his master is dependent on his giving money to speed up the setting free. Inheritance, testimony and the hudud are obliged for him and the inviolability of being set free is established for him. He is not buying dirhams for dirhams or gold for gold. Rather it is like a man who having said to his slave, 'Bring me such-and-such an amount of dinars and you are free', then reduces that for him, saying, 'If you bring me less than that, you are free.' That is not a fixed debt. Had it been a fixed debt, the master would have shared with the creditors of the mukatab when he died or went bankrupt. His claim on the property of the mukatab would join theirs
