রেওয়ায়ত ৭২. মালিক (রহঃ) বলেনঃ তাহার নিকট রেওয়ায়ত পৌছিয়াছে যে, আলী ইবন আবি তালীব (রাঃ) হাকামাইন (حكمين সালিসের ব্যক্তিদ্বয়) সম্পর্কে বলিয়াছেন (যাহাদের বিষয়ে) আল্লাহ্ তা'আলা বলিয়াছেনঃ وَإِنْ خِفْتُمْ شِقَاقَ بَيْنِهِمَا فَابْعَثُوا حَكَمًا مِنْ أَهْلِهِ وَحَكَمًا مِنْ أَهْلِهَا إِنْ يُرِيدَا إِصْلاَحًا يُوَفِّقِ اللَّهُ بَيْنَهُمَا إِنَّ اللَّهَ كَانَ عَلِيمًا خَبِيرًا অর্থাৎ স্বামী-স্ত্রী উভয়ের মধ্যে তোমরা যদি বিবাদের আশংকা কর তবে স্বামীর পরিজন হইতে একজন এবং স্ত্রীর পরিজন হইতে একজন হাকম (ফয়সালাকারী, বিবাদ মীমাংসাকারী) প্রেরণ কর যদি তাহারা উভয়ে মীমাংসার ইচ্ছা করেন। আল্লাহ তাহদের তওফীক দান করিবেন, আল্লাহ নিশ্চয় সর্বজ্ঞ, সর্ববিষয়ে অবহিত । অর্থাৎ-তাহাদের হাতে স্বামী-স্ত্রী উভয়ের বিচ্ছেদ ও মিলন-এই দুইয়ের সুযোগ রহিয়াছে। মালিক (রহঃ) বলেনঃ সালিসের ব্যক্তিদ্বয়ের ফয়সালা স্বামী-স্ত্রীর বিচ্ছেদ ও মিলনের ব্যাপারে প্রযোজ্য হইবে, ইহাই সর্বোত্তম যাহা আমি আলিম ব্যক্তিদের নিকট শুনিয়াছি।
Yahya related to me from Malik that he had heard that Ali ibn Abi Talib said about the two arbiters about whom Allah, the Exalted, said,"If you fear a breach between the two, appoint an arbiter from his people, and an arbiter from her people. If they desire to set things aright, Allah will make peace between them, surely Allah is Knowing, Aware," (Sura 4 ayat 35), that the separation and the joining were overseen by the two of them. Malik said, "That is the best of what I have heard from the people of knowledge. Whatever the two arbiters say concerning separation or joining is taken into consideration
রেওয়ায়ত ৭১. সাঈদ ইবন মুসায়্যিব (রহঃ) বলিয়াছেনঃ মুসতাহাজা (রোগের কারণে যাহার অনিয়মিত স্রাব হয়) ঐ নারীর ইদ্দত হইতেছে এক বৎসর। মালিক (রহঃ) বলেনঃ তালাকপ্রাপ্তা স্ত্রীলোক সম্পর্কে আমাদের মাস'আলা হইল, এই তালাকপ্রাপ্ত হওয়ার পর যেই স্ত্রীলোকের রক্তস্রাব বন্ধ হইয়া যায়, সে নয় মাস পর্যন্ত অপেক্ষা করিবে। এই নয় মাসের মধ্যে ঋতুস্রাব না হইলে তবে তিন মাস ইদ্দত পালন করিবে। আর তিন মাস পূর্ণ করার পূর্বে যদি ঋতুস্রাব হয় তবে পুনরায় হায়য-এর ইদ্দত পালন শুরু করবে। কিন্তু যদি হায়য আসার পূর্বে নয় মাস পূর্ণ হইয়া যায় তবে তিন মাস ইদ্দত পালন করবে। আর তৃতীয় মাসে উপনীত হইয়াছে এমন অবস্থায় যদি ঋতুস্রাব হয় তবে সে ইদ্দতের সময় পূর্ণ করিয়াছে। অন্য পক্ষে যদি তাহার ঋতুস্রাব না হয় তবে তিনমাস ইদ্দত পূর্ণ করিবে। তারপর অন্য স্বামীর রুজু করার অধিকার থাকিবে, কিন্তু যদি সে বায়েন তালাক দিয়া থাকে তবে আর রুজু করিতে পারিবে না। মালিক (রহঃ) বলেনঃ আমাদের নিকট সুন্নাত (নিয়ম হইল) এই যে, যদি কোন লোক তাহার স্ত্রীকে তালাক দেয় এবং সেই স্ত্রীকে পুনরায় গ্রহণ করার (রুজু করা) ইখতিয়ারও তাহার থাকে, এমতাবস্থায় স্ত্রী কিছু ইদ্দত পালন করিয়াছে। অতঃপর স্বামী তাহার প্রতি রুজু করিয়াছে এবং তাহাকে স্পর্শ করার পূর্বে পুনরায় তালাক দিয়াছে। তবে সেই স্ত্রী ইদ্দতের যাহা অতীত হইয়াছে উহার উপর ভিত্তি করিবে না বরং সে তাহাকে (দ্বিতীয়বার) তালাক দেওয়ার দিন হইতে নূতনভাবে ইদ্দত পালন করিবে, তাহার স্বামী এইরূপ করিয়া নিজের ক্ষতি করিয়াছে এবং তাহার আবশ্যক না থাকিলে স্ত্রীর দিকে রুজু করিয়া সে ভুল করিয়াছে। মালিক (রহঃ) বলেনঃ স্ত্রী যদি ইসলাম গ্রহণ করে তাহার স্বামী (তখনও) কাফের। তারপর স্বামীও ইসলাম গ্রহণ করিল, তবে আমাদের নিকট ফয়সালা হইতেছে এইঃ ইদ্দতে থাকা পর্যন্ত সময়ের মধ্যে তাহার স্বামী তাহার হকদার হইবে, আর যদি ইদ্দত শেষ হইয়া যায় তবে তাহার জন্য স্ত্রীকে পাওয়ার কোন পথ নাই। আর যদি ইদ্দত সমাপ্তির পর তাহাকে বিবাহ করে তবে পূর্বে প্রদত্ত তালাক তালাক বলিয়া গণ্য হইবে না। এই ঘটনায় স্ত্রীকে বিচ্ছেদ করাইয়াছে ইসলাম গ্রহণ, তালাক নহে।
Yahya related to me from Malik from Ibn Shihab that Said ibn al- Musayyab said, "The idda of the woman who bleeds constantly is a year." Malik said, "What is done among us about a divorced woman whose periods stop when her husband divorces her is that she waits nine months. If she has not had a period in them, she has an idda of three months. If she has a period before the end of the three months, she accepts the period. If another nine months pass without her having a period, she does an idda of three months. If she has a second period before the end of those three months, she accepts the period. If nine months then pass without a period, she does an idda of three months. If she has a third period, the idda of the period is complete. If she does not have a period, she waits three months, and then she is free to marry. Her husband can return to her before she becomes free to marry unless he made her divorce irrevocable." Malik said, "The sunna with us is that when a man divorces his wife and has the option to return to her, and she does part of her idda and then he returns to her and then parts from her before he has had intercourse with her, she does not add to what has passed of her idda. Her husband has wronged himself and erred if he returned to her and had no need of her." Malik said, "What is done among us is that if a woman becomes a muslim while her husband is a kafir and then he becomes muslim, he is entitled to her as long as she is in her idda. If her idda is finished, he has no access to her. If he remarries her after the end of her idda, however, that is not counted as divorce. Islam removed her from him without divorce
Yahya related to me from Malik that he had heard that Umar ibn al-Khattab, Abdullah ibn Umar, Abdullah ibn Masud, Salim ibn Abdullah, al-Qasim ibn Muhammad, Ibn Shihab,and Sulayman ibn Yasar all said, "If a man has vowed to divorce his wife before marrying her and then he breaks his vow, divorce is obligatory for him when he marries her
