রেওয়ায়ত ৬. মালিক (রহঃ) বলেনঃ তাহার নিকট রেওয়ায়ত পৌছিয়াছে যে, যে ব্যক্তি তাহার স্ত্রীকে “তুমি আমার জন্য হারাম” এরূপ বলিয়াছে সেই ব্যক্তি সম্পর্কে আলী ইবন আবি তালিব (রাঃ) বলিয়াছেন যে, উহা তিন তালাক গণ্য হইবে। মালিক (রহঃ) বলেনঃ এ বিষয়ে আমি যাহা শুনিয়াছি তন্মধ্যে ইহাই উত্তম।
Yahya related to me from Malik that he had heard that Ali ibn Abi Talib used to say that if a man said to his wife, "You are haram for me," it counted as three pronouncements of divorce. Malik said, "That is the best of what I have heard on the subject
রেওয়ায়ত ৭. নাফি হইতে বর্ণিত, আবদুল্লাহ ইবন উমর (রাঃ) বলিতেন, ‘বারিয়্যা’ এবং ‘খালিয়্যা’ উভয় শব্দের প্রত্যেকটির দ্বারা তিন তালাক প্রযোজ্য হইবে।
Yahya related to me from Malik from Nafi that Abdullah ibn Umar said that statements like "I cut myself off from you",or"You are abandoned", were considered as three pronouncements of divorce. Malik said that any strong statements such as these or others were considered as three pronouncements of divorce for a woman whose marriage had been consummated. In the case of a woman whose marriage had not been consummated, the man was asked to make an oath on his deen, as to whether he had intended one or three pronouncements of divorce. If he had intended one pronouncement, he was asked to make an oath by Allah to confirm it, and he became a suitor among other suitors, because a woman whose marriage had been consummated, required three pronouncements of divorce to make her inaccessible for the husband, whilst only one pronouncement was needed to make a woman whose marriage had not been consummated inaccessible. রেওয়ায়ত ৫. মালিক (রহঃ)-এর নিকট রেওয়ায়ত পৌছিয়াছে যে, ইরাক হইতে উমর ইবন খাত্তাব (রাঃ)-এর নিকট লেখা হইল যে, এক ব্যক্তি তাহার স্ত্রীকে বলিয়াছে حَبْلُكِ عَلَى غَارِبِكِ [তোমার রজ্জ্ব তোমার ঘাড়ে]। উমর ইবন খাত্তাব (রাঃ) তাহার নিযুক্ত ইরাকের প্রশাসকের নিকট পত্র লিখিলেন-হজ্জ মওসুমে সেই ব্যক্তিকে আমার সহিত মিলিত হইতে নির্দেশ দাও। উমর যখন বায়তুল্লাহর তওয়াফ করিয়াছিলেন তখন এক ব্যক্তি তাহার সম্মুখে আসিয়া সালাম করিল। উমর বলিলেনঃ তুমি কে? সেই ব্যক্তি বলিল, আমি সেই ব্যক্তি, যে ব্যক্তিকে আপনার নিকট (হজ্জ মওসুমে) উপস্থিত হইতে নির্দেশ প্রদান করিয়াছিলেন। তারপর উমর (রাঃ) বলিলেনঃ এই (পবিত্র কাবা) গৃহের মালিকের কসম দিয়া তোমাকে আমি প্রশ্ন করিতেছি যে, তুমি তোমার সেই বক্তব্য حَبْلُكِ عَلَى غَارِبِكِ এর দ্বারা কি উদ্দেশ্য করিয়াছ? সেই ব্যক্তি বলিল, এই স্থান ব্যতীত অন্য কোথাও আপনি আমাকে হলফ করাইলে আমি সত্য কথা বলিতাম না। আমি (এই বক্তব্য দ্বারা স্ত্রীকে) বিদায় (দেওয়া)-এর নিয়্যত করিয়াছি। উমর ইবন খাত্তাব (রাঃ) বলিলেন, তুমি যাহা নিয়্যত করিয়াছ তাহাই।
Yahya related to me from Malik that he had heard that Umar ibn al-Khattab had heard in a letter from Iraq that a man said to his wife, "Your rein is on your withers (i.e. you have free rein)." Umar ibn al-Khattab wrote to his governor to order the man to come to him at Makka at the time of hajj. While Umar was doing tawaf around the House, a man met him and greeted him. Umar asked him who he was, and he replied that he was the man that he had ordered to be brought to him. Umar said to him, "I ask you by the Lord of this building, what did you mean by your statement, 'Your rein is on your withers.'?" The man replied, "Had you made me swear by other than this place, I would not have told you the truth. I intended separation by that." Umar ibn al- Khattab said, "It is what you intended
রেওয়ায়ত ৮. কাসিম ইবন মুহাম্মদ (রহঃ) হইতে বর্ণিত-কোন এক গোত্রের দাসী এক ব্যক্তির স্ত্রী ছিল। সে ব্যক্তি উক্ত দাসীর অভিভাবকদের বলিল, আপনারা তাহার দায়িত্বভার গ্রহণ করুন। ইহা দ্বারা লোকেরা এক তালাক প্রদান করিয়াছে বলিয়া অনুমান করিলেন।
Yahya related to me from Malik from Yahya ibn Said from al-Qasim ibn Muhammad that a certain man had taken a slave-girl belonging to somebody else as a wife. He said to her people, "She is your concern," and people considered that to be one pronouncement of divorce
