। জাবির (রাঃ) থেকে বর্ণিত। তিনি বলেন, রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম হত্যাকারী নারীর উপর ধার্যকৃত দিয়াত প্রদানের দায় তার বংশীয় আত্মীয়গণের উপর আরোপ করেন। তখন নিহত নারীর বংশীয় আত্মীয়রা বললো, ইয়া রাসূলুল্লাহ! তার মীরাছ কি আমরা পাবো? তিনি বলেনঃ না, তার মীরাছ তার স্বামী ও সন্তানের প্রাপ্য।
It was narrated that Jabir said:“The Messenger of Allah (ﷺ) ruled that the blood money should be paid by the near male relations from the father's side of the killer, and the such relatives of slain woman said: 'O Messenger of Allah (ﷺ),her legacy is for us.' He said: 'No, her legacy is for her husband and children.'”
। আমর ইবনে শুআইব (রাঃ) থেকে পর্যায়ক্রমে তার পিতা ও তার দাদার সূত্রে বর্ণিত। তিনি বলেন, রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম সিদ্ধান্ত দিয়েছেন যে, কোন নারীর উপর দিয়াত বাধ্যকর হলে তার তার বিদ্যমান (বংশীয়) আত্মীয়গণ পরিশোধ করবে। কিন্তু তারা তার ওয়ারিস হবে না। তবে তার ওয়ারিসদের প্রদানের পর কিছু অবশিষ্ট থাকলে তা তারা পেতে পারে। কোন নারী নিহত হলে তা দিয়াত পাবে তার ওয়ারিসগণ। তারাই হত্যাকারীকে (কিসাসস্বরূপ) হত্যা করার অধিকারী।
It was narrated from 'Amr bin Shu'aib, from his father, that his grandfather said:“The Messenger of Allah (ﷺ) ruled that a woman's blood money (if she kills someone) should be paid by her male relatives on her father's side, whoever they are, and they should not inherit anything from her, except what is left over after her heirs have been taken their shares. If she is killed than her blood money is to be shared among her heirs, since they are the ones who may kill the one who killed her.”
حَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى أَبُو مُوسَى، حَدَّثَنَا خَالِدُ بْنُ الْحَارِثِ، وَابْنُ أَبِي عَدِيٍّ، عَنْ حُمَيْدٍ، عَنْ أَنَسٍ، قَالَ كَسَرَتِ الرُّبَيِّعُ عَمَّةُ أَنَسٍ ثَنِيَّةَ جَارِيَةٍ فَطَلَبُوا الْعَفْوَ فَأَبَوْا فَعَرَضَ عَلَيْهِمُ الأَرْشَ فَأَبَوْا فَأَتَوُا النَّبِيَّ صلى الله عليه وسلم فَأَمَرَ بِالْقِصَاصِ . فَقَالَ أَنَسُ بْنُ النَّضْرِ يَا رَسُولَ اللَّهِ تُكْسَرُ ثَنِيَّةُ الرُّبَيِّعِ وَالَّذِي بَعَثَكَ بِالْحَقِّ لاَ تُكْسَرُ . فَقَالَ النَّبِيُّ صلى الله عليه وسلم " يَا أَنَسُ كِتَابُ اللَّهِ الْقِصَاصُ " . قَالَ فَرَضِيَ الْقَوْمُ فَعَفَوْا فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " إِنَّ مِنْ عِبَادِ اللَّهِ مَنْ لَوْ أَقْسَمَ عَلَى اللَّهِ لأَبَرَّهُ " .
। আনাস (রাঃ) থেকে বর্ণিত। তিনি বলেন, তার ফুফু রুবায়্যি একটি বালিকার সামনের পাটির দাঁত ভেঙ্গে ফেলেছিল। অপরাধীর গোত্র ক্ষমা প্রার্থনা করলে আহতের গোত্র তা অস্বীকার করে। তারা দিয়াত প্রদানের প্রস্তাব দিলে তাও তারা প্রত্যাখ্যান করে। অতঃপর তারা নবী সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম’র নিকট উপস্থিত হলে, তিনি কিসাস গ্রহণের নির্দেশ দেন। তখন আনাস ইবনুন নাযর (রাঃ) বলেন, ইয়া রাসূলাল্লাহ! রুবায়্যির সামনের পাটির দাঁত ভেঙ্গে ফেলা হবে। সেই সত্তার শপথ, যিনি আপনাকে সত্য দীনসহ প্রেরণ করেছেন, তার দাঁত ভাঙ্গা যাবে না। নবী সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বলেনঃ হে আনাস! আল্লাহর কিতাবের বিধান হলো কিসাস। রাবী বলেন, তখন আহত মেয়েটির গোত্র সম্মত হয়ে (কিসাস) ক্ষমা করে দেয়। তখন রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বলেনঃ আল্লাহ্র বান্দাদের মধ্যে এমন লোকও আছে, যে আল্লাহর নামে শপথ করলে আল্লাহ তা অবশ্যই পূর্ণ করার ব্যবস্থা করেন।
It was narrated that Anas said:“Rubai, the paternal aunt of Anas, broke the tooth of a girl and they (her family) asked (the girl's family) to let her off, but they refused. They offered to pay compensatory money, but they refused. So they came to Prophet (ﷺ) who ordered retaliation. Anas bin Nadr said: 'O Messenger of Allah (ﷺ), will the tooth of Rubai' be broken? By the One Who sent you with the truth, it will not be broken!' The Prophet (ﷺ) said: 'O Anas, what Allah has decreed is retaliation.' So the people accepted that and forgave her. The Messenger of Allah (ﷺ) said: 'there are among the slaves of Allah those who, if they swear by Allah, Allah fulfills their oath.'”
। ‘আমর ইবনে শু‘আইব (রহঃ) থেকে বর্ণিত। মুদলিজ গোত্রীয় আবূ কাতাদা নামক এক ব্যক্তি নিজ পুত্রকে হত্যা করে। উমার (রাঃ) তার থেকে একশত উট আদায় করেন, যার মধ্যে ছিল তিরিশটি হিক্কা, তিরিশটি জাযাআ এবং চল্লিশটি গর্ভবতী উষ্ট্রী। অতঃপর তিনি বললেন, নিহতের ভাই কোথায়? আমি রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম কে বলতে শুনেছিঃ হত্যাকারীর জন্য (নিহতের) উত্তরাধিকার স্বত্ব নাই।
It was narrated from 'Amr bin Shu'aib that :Abu Qatadah, a man from Banu Mudlij, killed his son, and 'Umar took one hundred camels from him, thirty Hiqqah, thirty Jadha'ah and forty Khalifah. Then he said: “Where is the brother of slain? I heard the Messenger of Allah (ﷺ) say: 'The killer does not inherit.'”
