আবূ হুরাইরাহ ও যায়দ ইবনু খালিদ (রাঃ) হতে বর্ণিত যে, অবিবাহিতা দাসী যিনা করলে তার হুকুম সম্পর্কে রাসূলুল্লাহ্ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম-কে জিজ্ঞেস করা হল। তিনি বললেনঃ সে যদি যিনা করে তাকে তোমরা বেত্রাঘাত করবে। আবার যদি যিনা করে তাহলেও বেত্রাঘাত করবে। তারপর যদি যিনা করে তাহলেও বেত্রাঘাত করবে। এরপর তাকে একগুচ্ছ চুলের বিনিময়ে হলেও বিক্রি করে ফেলবে। ইবনু শিহাব (রহ.) বলেন, আমি জানি না যে, (বিক্রির কথা) তৃতীয়বারের পর না চতুর্থবারের পর। [২১৫২, ২১৫৩] (আধুনিক প্রকাশনী- ৬৩৬২, ইসলামিক ফাউন্ডেশন)
Narrated Abu Huraira and Zaid bin Khalid:
The verdict of Allah's Messenger (ﷺ) was sought about an unmarried slave girl guilty of illegal intercourse. He replied, "If she commits illegal sexual intercourse, then flog her (fifty stripes), and if she commits illegal sexual intercourse (after that for the second time), then flog her (fifty stripes), and if she commits illegal sexual intercourse (for the third time), then flog her (fifty stripes) and sell her for even a hair rope." Ibn Shihab said, "I am not sure whether the Prophet (ﷺ) ordered that she be sold after the third or fourth time of committing illegal intercourse
حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ، حَدَّثَنَا اللَّيْثُ، عَنْ سَعِيدٍ الْمَقْبُرِيِّ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ، أَنَّهُ سَمِعَهُ يَقُولُ قَالَ النَّبِيُّ صلى الله عليه وسلم " إِذَا زَنَتِ الأَمَةُ فَتَبَيَّنَ زِنَاهَا فَلْيَجْلِدْهَا وَلاَ يُثَرِّبْ، ثُمَّ إِنْ زَنَتْ فَلْيَجْلِدْهَا وَلاَ يُثَرِّبْ، ثُمَّ إِنْ زَنَتِ الثَّالِثَةَ فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعَرٍ ". تَابَعَهُ إِسْمَاعِيلُ بْنُ أُمَيَّةَ عَنْ سَعِيدٍ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ صلى الله عليه وسلم.
আবূ হুরাইরাহ (রাঃ) হতে বর্ণিত:
তিনি বলেন, নবী সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বলেছেন, দাসী যখন যিনা করে আর প্রমাণিত হয়ে যায়, তখন যেন তাকে বেত্রাঘাত করে এবং তিরস্কার না করে। আবার যদি যিনা করে তাহলেও যেন বেত্রাঘাত করে, তিরস্কার না করে। যদি তৃতীয়বারও যিনা করে তাহলে যেন চুলের একটি রশির বিনিময়ে হলেও তাকে বিক্রি করে দেয়। ইসমাঈল ইবনু উমাইয়াহ (রহ.) সা‘ঈদ ..... আবূ হুরাইরাহ (রাঃ) সূত্রে নবী সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম থেকে লায়স (রহ.) এর অনুসরণ করেছেন। (আধুনিক প্রকাশনী- ৬৩৬৩, ইসলামিক ফাউন্ডেশন)
Narrated Abu Huraira:
The Prophet (ﷺ) said, "If a lady slave commits illegal sexual intercourse and she is proved guilty of illegal sexual intercourse, then she should be flogged (fifty stripes) but she should not be admonished; and if she commits illegal sexual intercourse again, then she should be flogged again but should not be admonished; and if she commits illegal sexual intercourse for the third time, then she should be sold even for a hair rope
আবূ হুরাইরাহ ও যায়দ ইবনু খালিদ (রাঃ) হতে বর্ণিত যে, এক বেদুঈন নবী সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম-এর নিকট এল। এ সময় তিনি উপবিষ্ট ছিলেন। সে বলল, হে আল্লাহর রাসূল! আমাদের মধ্যে আল্লাহর কিতাব মুতাবিক ফায়সালা করে দিন। এরপর তার প্রতিপক্ষ দাঁড়াল এবং বলল, এ সত্যই বলেছে হে আল্লাহর রাসূল! আল্লাহর কিতাব মুতাবিক আমাদের ফায়সালা করে দিন। আমার ছেলে তার অধীনে চাকর ছিল, সে তার স্ত্রীর সাথে যিনা করে ফেলে। তখন লোকেরা আমাকে জানাল যে, আমার ছেলের উপর পাথর মেরে হত্যার হুকুম হবে। ফলে আমি একশ’ ছাগল ও একজন দাসী দিয়ে আপোস করে নেই। এরপর আমি আলিমদেরকে জিজ্ঞেস করি, তখন তাঁরা বললেন যে, আমার ছেলের দন্ড হল একশ’ বেত্রাঘাত ও এক বছরের নির্বাসন। তা শুনে তিনি বললেন, কসম ঐ সত্তার যাঁর হাতে আমার প্রাণ! আমি অবশ্যই তোমাদের উভয়ের মধ্যে আল্লাহর কিতাব অনুযায়ী ফায়সালা করে দেব। ঐ ছাগল ও দাসীটি তোমার কাছে ফিরিয়ে দেয়া হবে আর তোমার ছেলের জন্য সাব্যস্ত হবে একশ’ বেত্রাঘাত ও এক বছরের নির্বাসন। হে উনাইস! তুমি সকালে ঐ নারীর কাছে যাও এবং তাকে পাথর মেরে হত্যা কর। উনাইস সকালে গেলেন ও তাকে পাথর মেরে হত্যা করলেন। [২৩১৪, ২৩১৫] (আধুনিক প্রকাশনী- ৬৩৬১, ইসলামিক ফাউন্ডেশন)
Narrated Abu Huraira and Zaid bin Khalid:
A bedouin came to the Prophet (ﷺ) while he (the Prophet) was sitting, and said, "O Allah's Messenger (ﷺ)! Give your verdict according to Allah's Laws (in our case)." Then his opponent got up and said, "He has told the truth, O Allah's Messenger (ﷺ)! Decide his case according to Allah's Laws. My son was a laborer working for this person, and he committed illegal sexual intercourse with his wife, and the people told me that my son should be stoned to death, but I offered one-hundred sheep and a slave girl as a ransom for him. Then I asked the religious learned people, and they told me that my son should be flogged with one-hundred stripes and be exiled for one year." The Prophet (ﷺ) said, "By Him in Whose Hand my soul is, I will judge you according to Allah's Laws. The sheep and the slave girl will be returned to you and your son will be flogged one-hundred stripes and be exiled for one year. And you, O Unais! Go to the wife of this man (and if she confesses), stone her to death." So Unais went in the morning and stoned her to death (after she had confessed)
তিনি বলেন, আমি ‘আবদুল্লাহ্ ইবনু আবূ ‘আওফা (রাঃ)-কে পাথর মেরে হত্যা সম্বন্ধে জিজ্ঞেস করলাম। তখন তিনি বললেন, নবী সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম পাথর মেরে হত্যা করেছেন। আমি বললাম, সূরায়ে নূরের (আয়াত নাযিলের) আগে না পরে? তিনি বললেন, তা আমি জানি না। [৬৮১৩] ‘আলী ইবনু মুসহির, খালিদ ইবনু ‘আবদুল্লাহ্ মুহারিবী ও আবিদা ইবনু হুমায়দ (রহ.) আশ-শায়বানী (রহ.) থেকে আবদুল ওয়াহিদ এর অনুসরণ করেছেন। (আধুনিক প্রকাশনী- ৬৩৬৪, ইসলামিক ফাউন্ডেশন)
Narrated Ash-Shaibani:
I asked `Abdullah bin Abi `Aufa about the Rajam (stoning somebody to death for committing illegal sexual intercourse). He replied, "The Prophet (ﷺ) carried out the penalty of Rajam," I asked, "Was that before or after the revelation of Surat-an-Nur?" He replied, "I do not know
