। আবূ হুরাইরাহ (রাঃ) বর্ণনা করেন, রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বলেনঃ চতুষ্পদ জন্তু আহত হলে তা কিসাসযোগ্য নয়, খনিতে চাপা পড়ে ও কূপের মধ্যে পড়ে মারা গেলে নিহত ব্যক্তির রক্তমূল্য ক্ষমা এবং মাটির নীচের প্রাপ্ত সম্পদের এক-পঞ্চমাংশ (সরকারকে) দিতে হবে। ইমাম আবূ দাঊদ (রহঃ) বলেন, জন্তু যদি দিবাভাগে মাঠে চলাকালে আহত করে এবং সঙ্গে রাখাল না থাকে তাহলে মাফ, কিন্তু এরূপ রাতের বেলা সংঘটিত হলে এ হুকুম প্রযোজ্য নয়।[1] সহীহ।
Narrated Abu Hurairah:
The Messenger of Allah (ﷺ) as saying: No retaliation is payable for a wound caused by a dumb animal, for a mine, and for a well. On the treasure found buried in the land there is a fifth. Abu Dawud said: A dumb animal means an animal which is free and has not tether, and there is no one (as a watchman) with it. It causes harm by day and not by night
। আনাস ইবনু মালিক (রাঃ) সূত্রে বর্ণিত। তিনি বলেন, একদা আনাস ইবনুল নাদর (রাঃ)-এর বোন রুবাই (রাঃ) এক মহিলার সামনের একটি দাঁত ভেঙ্গে ফেলেন। তারা নবী সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম-এর নিকট এলে তিনি আল্লাহর কিতাব অনুসারে কিসাসের হুকুম দেন। আনাস ইবনুল নাদর (রাঃ) বললেন, আপনাকে যে পবিত্র সত্তা সত্য দ্বীনসহ পাঠিয়েছেন তাঁর কসম! আজ তার দাঁত উপড়ে ফেলবেন না। তিনি বললেন, হে আনাস! আল্লাহর কিতাবের নির্দেশ হলো কিসাস। এরপর বিবাদী পক্ষ দিয়াত গ্রহণে রাযী হলো। নবী সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম এতে অবাক হয়ে বললেন, ‘‘আল্লাহর কিছু বান্দা আছে, তারা আল্লাহর উপর কসম করলে আল্লাহ তাদের কসমকে পূর্ণ করেন। ইমাম আবূ দাঊদ (রহঃ) বলেন, আমি আহমাদ ইবনু হাম্বাল (রহঃ)-এর নিকট শুনেছি তাকে প্রশ্ন করা হলো, দাঁতের কিসাস সম্পর্কে। তিনি বলেন, এক ফালি কাঠ দ্বারা তা ভেঙ্গে দিতে হবে।[1] সহীহ।
Narrated Anas bin Malik:
Al-Rubayyi', sister of Anas b. al-Nadr, broke (one of) the front teeth of a woman. They came to the Prophet (ﷺ). He made a decision in accordance with the Book of Allah that retaliation should be taken. Anas b. al-Nadr said: I swear by Him who has sent you the truth, her front tooth will not be broken today. He replied: Anas ! Allah's decree is retaliation. But the people were agreeable to accepting a fine, so the Prophet (ﷺ) said: Among Allah's servants there are those who, if they adjured Allah, He (Allah) would consent to it. Abu Dawud said: I heard Ahmad b. Hanbal say: He was asked : How retaliation of a tooth is taken ? He said: It is broken with a file
The Prophet (ﷺ) said: No recompense is to be demanded if one is kicked by an animal. Abu Dawud said: An animal kicks someone with its leg while one is riding on it
