حَدَّثَنَا أَحْمَدُ بْنُ حَنْبَلٍ، حَدَّثَنَا هُشَيْمٌ، أَخْبَرَنَا دَاوُدُ، عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ، قَالَ قَالَ رَسُولُ صلى الله عليه وسلم " الْعُمْرَى جَائِزَةٌ لأَهْلِهَا وَالرُّقْبَى جَائِزَةٌ لأَهْلِهَا " .
। জাবির (রাঃ) সূত্রে বর্ণিত। তিনি বলেন, রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বলেছেনঃ যাকে জীবনস্বত্ব দেয়া হয় সেটা তারই হয়ে যায়। রুকবা যাকে দেয়া সে-ই হয় এর স্বতাধিকারী।
Narrated Jabir ibn Abdullah:
The Prophet (ﷺ) said: Life-tenancy is lawful for the one to whom it is given and donation of property to go to the survivor is lawful to whom it is given
। জাবির ইবনু ‘আব্দুল্লাহ (রাঃ) সূত্রে বর্ণিত। তিনি বলেন, রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম জনৈক আনসারী মহিলাকে তার পুত্র কর্তৃক দান করা একটি খেজুর বাগান সম্পর্কে ফায়সালা দিয়েছিলেন। অতঃপর মহিলাটি মারা গেলে তার ছেলে বললো, আমি তাকে তার জীবিত থাকাকালীন সময়ের জন্যই দান করেছিলাম। ছেলেটির আরো কয়েকটি ভাই ছিলো। রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বললেনঃ জীবিত ও মৃত্যু উভয় অবস্থায়ই বাগানটি তার হয়ে গেছে। ছেলেটি বললো, বাগানটি আমি তাকে সাদাকাহ স্বরূপ দিয়েছিলাম। তিনি বললেনঃ তাহলে তো এটা তোমার থেকে দূরে সরে গেছে।
Narrated Jabir ibn Abdullah:
The Messenger of Allah (ﷺ) decided a case of a woman from the Ansar to whom an orchard of date-palms was given by her son. She then died. Her son said: I gave it to her for her life, and she has brothers. Thereupon the Messenger of Allah (ﷺ) said: It belongs to her during her life and after death. He then said: I gave a sadaqah (charity to her. He replied: It is more unexpected from you)
। যায়িদ ইবনু সাবিত (রাঃ) সূত্রে বর্ণিত। তিনি বলেন, রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বলেছেনঃ যদি কেউ কাউকে জীবনস্বত্বরূপে কিছু দান করে তাহলে যাকে তা দান করা হয়েছে সে-ই হবে জীবনে-মরণে এর স্বতাধিকারী। তোমরা রুকবা করো না। কেউ রুকবা করলে তা গ্রহীতার মালিকানায় চলে যায়।
Narrated Zayd ibn Thabit:
The Prophet (ﷺ) said: If anyone gives something in life-tenancy, it belongs to the one to whom it is given, in his life and after his death; and do not give property to go to the survivor, for if anyone gives something to to to the survivor, it belongs to him
حَدَّثَنَا إِسْحَاقُ بْنُ إِسْمَاعِيلَ، حَدَّثَنَا سُفْيَانُ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ، عَنْ جَابِرٍ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ " لاَ تُرْقِبُوا وَلاَ تُعْمِرُوا فَمَنْ أُرْقِبَ شَيْئًا أَوْ أُعُمِرَهُ فَهُوَ لِوَرَثَتِهِ " .
। জাবির (রাঃ) সূত্রে বর্ণিত। নবী সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বলেনঃ তোমরা পুনরায় ফেরত পাবার আশায় এরূপ (বলে) দান করবে না যে, যদি আমি আগে মরে যাই তবে এটা তোমার; আর যদি তুমি আগে মরে যাও তবে এটা আমার। অথবা যতদিন তুমি বেঁচে থাকবে এটা তোমার। যাকে রুকবা অথবা জীবনস্বত্ব দান করা হয় সেটা তার উত্তরাধিকারীদের জন্য হয়ে যায়।
Narrated Jabir ibn Abdullah:
The Prophet (ﷺ) said: Do not give property to go to the survivor and do not give life-tenancy. If anyone is given something to the survivor or given life-tenancy, it goes to his heirs
