। সালিম (রহঃ) তার পিতা থেকে নবী সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম সূত্রে বর্ণনা করেছেন। তিনি বলেনঃ কেউ গোলাম বিক্রি করলে ঐ গোলামের যদি কোনো মাল থাকে তাহলে উক্ত মাল বিক্রেতাই পাবে। তবে ক্রেতা (মালের) শর্ত করলে সে তা পাবে। আর কেউ খেজুর গাছ তা‘বীর করার পর বিক্রি করলে ঐ বাগানের বর্তমান ফল বিক্রেতা পাবে, তবে ক্রেতা নিজের জন্য শর্ত করলে ভিন্ন কথা।
Narrated Ibn 'Umar:
The Prophet (ﷺ) as saying: If anyone buys a slave who possesses property. his property belongs to the seller unless buyer makes a provision and if anyone buys palm-trees after they have been fecundated, the fruit belongs to the seller unless the buyer make a provision
। আল-আলা ইবনু ‘আব্দুর রাহমান (রহঃ) থেকে আবূ মাজিদাহ (রহঃ) সূত্রে বর্ণিত। তিনি বলেন, আমি এক যুবকের কান কেটে ফেলেছিলাম অথবা কেউ আমার কান কেটে ফেলেছিল। হজ (হজ্জ) উপলক্ষে আবূ বাকর (রাঃ) আমাদের এখানে এলে ‘আমরা তার নিকট একত্র হলাম। তিনি আমাদেরকে ‘উমার ইবনুল খাত্তাব (রাঃ)-এর কাছে পাঠালেন। ‘উমার (রাঃ) বলেন, এ অপরাধের জন্য কিসাস নেয়া যাবে। হাজ্জামকে ডেকে আনো, যাতে কিসাস গ্রহণ করতে পারে। অতঃপর আমার নিকট একজন হাজ্জামকে ডেকে আনা হলে তিনি বললেন, আমি রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম-কে বলতে শুনেছিঃ আমি আমার খালাকে একটি গোলাম দান করেছিলাম। আমার আশা ছিলো, এতে তাঁর বরকত হবে। আমি তাকে বলেছিলাম, একে রক্তমোক্ষণকারী, স্বর্ণকার অথবা কসাইয়ের কাছে সোপর্দ করবেন না।
AbuMajidah said:I cut the ear of a boy, or he cut my ear (the narrator is doubtful). AbuBakr then came to us to perform hajj and we got together with him. But he referred us to Umar ibn al-Khattab. Umar (ibn al-Khattab) said: This reached the extent of retaliation. Call a cupper to me so that he may retaliate. When the cupper was called, he (Umar) said: I heard the Messenger of Allah (ﷺ) say: I gave a boy to my maternal aunt, and I hope that she will be blessed in respect of him. I said to her: Do not entrust him to a supper, nor to a goldsmith, nor to a butcher. Abu Dawud said: This tradition has also been transmitted by 'Abd al-A'la from Ibn Ishaq who said: Abu Majidah is a man of Banu Sahm narrating from 'Umar b. al-Khattab
