। সামুরাহ (রাযি.) সূত্রে বর্ণিত। নবী সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বলেনঃ কোনো নারীকে যদি দুই অভিভাবক বিয়ে দেয়, তবে প্রথম ওয়ালীর বিয়ে কার্যকরী হবে। কোনো ব্যক্তি যদি দুই লোকের কাছে কোনো জিনিস বিক্রি করে তাহলে দু‘জনের মধ্যে প্রথম ক্রেতাই তার প্রাপক।[1] দুর্বলঃ যঈফ আল-জামি‘উস সাগীর (২২২৪), যঈফ সুনান আত-তিরমিযী (১৮৯/১১২২), যঈফ সুনান নাসায়ী (৩১৬/৪৬৮২), মিশকাত (৩১৫৬), ইরওয়া (১৮৫৩)।
Narrated Samurah:
The Prophet (ﷺ) said: Any woman who is married by two guardians (to two different men) belongs to the first woman who is married by two guardians (to two different men) belongs to the first of them and anything sold by a man to two persons belongs to the first of them
। হাসান বাসরী (রহ.) সূত্রে বর্ণিত। তিনি বলেন, মা‘কিল ইবনু ইয়াসার (রাযি.) আমাকে বর্ণনা করেন যে, আমার এক বোন ছিলো। আমার নিকট তার বিয়ের ব্যাপারে পয়গাম আসতো। একদা আমার এক চাচাত ভাই আমার কাছে এলে আমি তার সাথে আমার বোনকে বিয়ে দিলাম। পরে সে তাকে এক তালাক রাজঈ দিয়ে ফেলে রাখলো। এমনকি তার ইদ্দাতকাল শেষ হলো। অতঃপর যখন তার বিয়ের পয়গাম আসতে থাকলো। আমার চাচাত ভাইও পুনরায় আমার কাছে পয়গাম পাঠালে আমি বললাম, আল্লাহর শপথ! আমি তাকে তার কাছে কখনোই বিয়ে দিবো না। বর্ণনাকারী বলেন, এরপর আমাকে কেন্দ্র করেই এ আয়াত অবতীর্ণ হয়ঃ ‘‘যখন তোমরা নারীদের তালাক দিবে, ইদ্দাতকাল শেষ হওয়ার পর যদি তারা তাদের পূর্ব-স্বামীকে বিয়ে করতে চায়, তাহলে তোমরা তাদেরকে বাধা দিও না’’... (সূরা আল-বাকারাহঃ ২৩২)। বর্ণনাকারী বলেন, অতঃপর আমি আমার শপথের কাফ্ফারাহ দিয়ে বোনকে তার সাথে বিয়ে দেই।[1] সহীহ।
Ma’qil bin Yasar said:I had a sister and I was asked to give her in marriage. My cousin came to me and I married her to him. He then divorced her one revocable divorce. He abandoned her till her waiting period passed. When I was asked to give her in marriage, he again came to me and asked her in marriage. Thereupon I said to him “No, by Allah, I will never marry her to you. Then the following verse was revealed about my case: “And when ye have divorced women and they reach their term, place not difficulties in the way of their marrying their husbands.” So I expiated for my oath, and married her off to him
। ‘আব্দুল্লাহ ইবনু ‘আব্বাস (রাযি.) সূত্রে বর্ণিত। ‘‘জোরপূর্বক কোনো মহিলার মালিক হওয়া তোমাদের জন্য বৈধ নয়। আর তোমরা তাদের অবরুদ্ধ করবে না।’’ (সূরা আন-নিসাঃ ১৯)। এ আয়াতের ঘটনা প্রসঙ্গে তিনি বলেন, (জাহিলী যুগে) কোনো ব্যক্তি মারা গেলে মৃতের ওয়ারিসরা মৃতের স্ত্রীর অভিভাবকের পরিবর্তে নিজেরাই মালিক হতো। ইচ্ছে হলে তাদের কেউ তাকে বিয়ে করতো বা তাকে অন্যত্র গিয়ে বিয়ে দিতো, অথবা বিয়ে দিতো না। এ প্রসঙ্গে উক্ত আয়াত অবতীর্ণ হয়।[1] সহীহ।
Narrated Abdullah ibn Abbas:
About the Qur'anic verse: "It is not lawful for you forcibly to inherit the woman (of your deceased kinsmen), nor (that) ye should put constraint upon them. When a man died, his relatives had more right to his wife then her own guardian. If any one of them wanted to marry her, he did so; or they married her (to some other person), and if they did not want to marry her, they did so. So this verse was revealed about the matter
। উম্মু হাবীবাহ (রাযি.) সূত্রে বর্ণিত। তিনি (‘উবাইদুল্লাহ) ইবনু জাহশের স্ত্রী ছিলেন। স্বামী মারা গেলে তিনি হিজরাতকারীদের সাথে হাবশায় হিজরাত করেন। অতঃপর হাবশার বাদশা নাজ্জাশী রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম-এর সাথে তাকে বিয়ে দেন। তিনি (অভিভাবক ছাড়া) তাদের কাছেই অবস্থান করেন।[1] সহীহ।
