حَدَّثَنَا قُتَيْبَةُ، أَخْبَرَنَا اللَّيْثُ، عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ، قَالَ جَاءَ عَبْدٌ فَبَايَعَ النَّبِيَّ صلى الله عليه وسلم عَلَى الْهِجْرَةِ وَلاَ يَشْعُرُ النَّبِيُّ صلى الله عليه وسلم أَنَّهُ عَبْدٌ فَجَاءَ سَيِّدُهُ يُرِيدُهُ فَقَالَ النَّبِيُّ صلى الله عليه وسلم " بِعْنِيهِ " . فَاشْتَرَاهُ بِعَبْدَيْنِ أَسْوَدَيْنِ ثُمَّ لَمْ يُبَايِعْ أَحَدًا بَعْدُ حَتَّى يَسْأَلَهُ أَعَبْدٌ هُوَ قَالَ وَفِي الْبَابِ عَنْ أَنَسٍ . قَالَ أَبُو عِيسَى حَدِيثُ جَابِرٍ حَدِيثٌ حَسَنٌ صَحِيحٌ . وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ أَنَّهُ لاَ بَأْسَ بِعَبْدٍ بِعَبْدَيْنِ يَدًا بِيَدٍ . وَاخْتَلَفُوا فِيهِ إِذَا كَانَ نَسِيئًا .
। জাবির (রাঃ) হতে বর্ণিত আছে, তিনি বলেন, রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লামের নিকট একজন ক্রিতদাস এসে হিজরাতের উদ্দেশ্যে তার নিকট শপথ করে। সে যে ক্রীতদাস রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম সেটা জানতেন না। তার মালিক এসে উপস্থিত হল তাকে ফেরত নেয়ার জন্য। রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বললেনঃ তুমি একে আমার নিকট বিক্রয় করে দাও। তিনি তাকে কিনলেন দুইটি হাবশী গোলামের বিনিময়ে। এরপর হতে কারো বাইআত গ্রহণের পূর্বে তিনি প্রশ্ন করে নিতেন, সে ক্রীতদাস কি না। সহীহ, বেচা-কেনার হাদীস, মুসলিম আনাস (রাঃ) হতেও এ অনুচ্ছেদে হাদীস বর্ণিত আছে। আবূ ঈসা ৰলেন, জাবির (রাঃ) হতে বর্ণিত হাদীসটি হাসান সহীহ। আলিমগণ এ হাদীস মোতাবিক আমল করেন। তাদের মতে দুটো গোলামের বিনিময়ে একটি গোলাম কেনাতে কোন সমস্যা নেই, তবে নগদ লেন-দেন হতে হবে। বাকীর মাধ্যমে এ জাতীয় লেনদেন সম্পাদন প্রসঙ্গে তাদের মধ্যে মতের অমিল আছে।
Narrated Jabir:
"A slave came to give the pledge to the Prophet (ﷺ) for Hijrah, but the Prophet (ﷺ) did not realize that he was a slave. So his master came to get him and the Prophet (ﷺ) said: 'Sell him to me.' So he purchased him for two black slaves. Then he would not pledge from anyone until he asked him if he was a slave." [He said:] There is something on this topic from Anas. [Abu 'Eisa said:] The Hadith of Jabir is a Hasan Sahih Hadith. This is acted upon according to the people of knowledge. There is no harm in a slave for two slaves in hand to hand exchange, but they differ when it is on credit
। জাবির (রাঃ) হতে বর্ণিত আছে, তিনি বলেন, রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বলেছেনঃ দু'টি পশুর বদলে একটি পশু ধারে (করজে) বিক্রয় করা জায়িয নয়, কিন্তু উপস্থিত (নগদ) লেনদেন হলে কোন সমস্যা নেই। সহীহ, ইবনু মা-জাহ (২২৭১) এ হাদিসটিকে আবু ঈসা হাসান সহীহ বলেছেন।
Narrated Jabir:
That the Messenger of Allah (ﷺ) said: "Animals [two for one] are not proper on credit, and there is no harm in a hand to hand (exchange)." The Hadith is Hasan Sahih
। উবাদা ইবনু সামিত (রাঃ) হতে বর্ণিত আছে, নবী সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বলেছেনঃ সমপরিমাণ স্বণের পরিবর্তে সমপরিমাণ স্বর্ণ হতে হবে; সমপরিমাণ রূপার পরিবর্তে সমপরিমাণ রূপা হতে হবে; সমপরিমাণ খেজুরের পরিবর্তে সমপরিমাণ খেজুর হতে হবে; সমপরিমাণ গমের পরিবর্তে সমপরিমাণ গম হতে হবে; সমপরিমাণ লবণের পরিবর্তে সমপরিমাণ লবণ হতে হবে এবং সমপরিমাণ যবের পরিবর্তে সমপরিমাণ যব হতে হবে। যে লোক এ সবের লেনদেনে বেশি পরিমাণ দিবে অথবা নিবে সে সূদে লেনদেনকারী বলে বিবেচিত হবে। তোমাদের ইচ্ছানুযায়ী রূপার পরিমাণের পরিবর্তে স্বর্ণের পরিমাণ নির্ধারণ করে নগদ বিক্রয় করতে পার। তোমাদের ইচ্ছানুযায়ী খেজুরের পরিমাণের পরিবর্তে গমের পরিমাণ নির্ধারণ করে নগদ বিক্রয় করতে পার। তোমাদের ইচ্ছানুযায়ী খেজুরের পরিমাণের পরিবর্তে যবের পরিমাণ ঠিক করে নগদ বিক্রয় করতে পার। সহীহ, ইবনু মা-জাহ (২২৫৪), মুসলিম আবূ সাঈদ, আবূ হুরাইরা, বিলাল ও আনাস (রাঃ) হতেও এ অনুচ্ছেদে হাদীস বর্ণিত আছে। উবাদা (রাঃ) হতে বর্ণিত হাদীসটিকে আবূ ঈসা হাসান সহীহ বলেছেন। উল্লেখিত হাদীসের অপর এক বর্ণনায় আছেঃ “তোমাদের ইচ্ছানুযায়ী গমের পরিমাণের পরিবর্তে যবের পরিমাণ নির্ধারণ করে নগদ বিক্রয় করতে পার”। আর এক বর্ণনায় আছেঃ “তোমাদের ইচ্ছানুযায়ী বার্লির পরিমাণের পরিবর্তে গমের পরিমাণ নির্ধারণ করে (পরিমাণে কম-বেশি করে) নগদ বিক্রয় করতে পার।" এ হাদীস অনুযায়ী বিশেষজ্ঞ আলিমগণ আমল করেছেন। তাদের মতে, সমপরিমাণ গমের পরিবর্তে সমপরিমাণ গম এবং সমপরিমাণ যবের পরিবর্তে সম-পরিমাণ যব বিক্রয় করতে কোন সমস্যা নেই। বিনিময়ের বস্তু দুটি যদি একই প্রজাতির না হয় তাহলে পরিমাণে কম-বেশি হলে কোন সমস্যা নেই, কিন্তু সেই ক্ষেত্রে নগদ আদান-প্রদান হতে হবে। এই মত প্রকাশ করেছেন রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লামের বেশিরভাগ বিশেষজ্ঞ সাহাবী ও তাবিঈ। সুফিয়ান সাওরী, আহমাদ ও ইসহাকেরও এই মত। শাফিঈ বলেন, এ কথার দলীল হল রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লামের বাণীঃ “তোমাদের ইচ্ছানুযায়ী গমের পরিমাণের পরিবর্তে যবের পরিমাণ ঠিক করে নগদ বিক্রয় করতে পার।” একদল আলিমের মতে যবের পরিবর্তে গমের পরিমাণ বেশি নির্ধারণ করে বিক্রয় করা মাকরূহ, উভয়ের পরিমাণ সমান থাকতে হবে। ইমাম মালিক এই মত পোষণ করেন। কিন্তু প্রথম মতই অনেক বেশি সহীহ।
Narrated 'Ubadah bin As-Samit:
That the Prophet (ﷺ) said: "Gold for gold, kind for kind; silver for silver, kind for kind; dried-dates for dried-dates, kind for kind; wheat for wheat, kind for kind; salt for salt, kind for kind; and barley for barley, kind for kind. Whoever increases or seeks an increase, then he dealt with Riba. Sell gold for silver as you wish, hand to hand; and sell wheat for dried-dates as you wish, hand to hand; and sell barley for dried-dates as you wish, hand to hand." [He said:] There are narrations on this topic from Abu Sa'eed, Abu Hurairah, Bilal, And Anas. [Abu 'Eisa said:] The Hadith of 'Ubadah bin As-Samit is Hasan Sahih. Some of them reported this Hadith from Khalid, with this chain, and he said: "Sell wheat for barley as you wish, hand to hand." Some of them reported this Hadith from Khalid, from Abu Qilabah, from Ash'ath, from 'Ubadah from the Prophet (ﷺ). In that Hadith, they added that Khalid said: "Abu Qilabah said: "Sell wheat for barley as you wish, hand to hand." This Hadith is acted upon according to the people of knowledge, they do not think that one may sell wheat for wheat except when it is the same kind for the same kind, and (the same for) barely in exchange for barley, kind for kind. When the items are themselves different, then there is no harm in one being more than the other if it is hand to hand. This is saying of most of the people of knowledge among the Companions of the Prophet (ﷺ) and others. It is the view of Sufyan Ath-Thawri, Ash-Shafi'i, Ahmad, and Ishaq. Ash-Shafi'i said: "And the proof for that is the saying of the Prophet (ﷺ): 'Sell barley for wheat as you wish, hand to hand.'" [Abu 'Eisa said:] Some of the people of knowledge considered it disliked that wheat be sold for barely unless it was kind for kind. This is the view of Malik bin Anas, but the first view is more correct
حَدَّثَنَا أَبُو مُوسَى، مُحَمَّدُ بْنُ مُثَنَّى حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ، عَنْ حَمَّادِ بْنِ سَلَمَةَ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ، عَنْ سَمُرَةَ، أَنَّ النَّبِيَّ صلى الله عليه وسلم نَهَى عَنْ بَيْعِ الْحَيَوَانِ بِالْحَيَوَانِ نَسِيئَةً . قَالَ وَفِي الْبَابِ عَنِ ابْنِ عَبَّاسٍ وَجَابِرٍ وَابْنِ عُمَرَ . قَالَ أَبُو عِيسَى حَدِيثُ سَمُرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ . وَسَمَاعُ الْحَسَنِ مِنْ سَمُرَةَ صَحِيحٌ هَكَذَا قَالَ عَلِيُّ بْنُ الْمَدِينِيِّ وَغَيْرُهُ . وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَكْثَرِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمْ فِي بَيْعِ الْحَيَوَانِ بِالْحَيَوَانِ نَسِيئَةً وَهُوَ قَوْلُ سُفْيَانَ الثَّوْرِيِّ وَأَهْلِ الْكُوفَةِ وَبِهِ يَقُولُ أَحْمَدُ . وَقَدْ رَخَّصَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمْ فِي بَيْعِ الْحَيَوَانِ بِالْحَيَوَانِ نَسِيئَةً وَهُوَ قَوْلُ الشَّافِعِيِّ وَإِسْحَاقَ .
। সামুরা (রাঃ) হতে বর্ণিত আছে, পশুর বিনিময়ে পশু ধারে (করজে) বিক্রয় করতে রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম নিষেধ করেছেন। সহীহ, ইবনু মা-জাহ (২২৭০) ইবনু আব্বাস, জাবির ও ইবনু উমার (রাঃ) হতেও এ অনুচ্ছেদে হাদীস বর্ণিত আছে। আবূ ঈসা বলেন, সামুরা (রাঃ) হতে বর্ণিত হাদীসটি হাসান সহীহ। আলী ইবনুল মাদীনী ও অন্যান্যের মতে সামুরা (রাঃ)-এর নিকট হাসান (রাহঃ) সরাসরি হাদীস শ্রবণ করেছেন। এ হাদীস মোতাবিক রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লামের বেশিরভাগ সাহাবী ও অন্যান্য আলিমগন আমল করেছেন। তাদের মতে, পশুর বিনিময়ে পশু ধারে বিক্রয় করা জায়িয নয়। এই মত দিয়েছেন সুফিয়ান সাওরী ও কূফাবাসী আলিমগণ। ইমাম আহমাদও একই রকম মত দিয়েছেন। পশুর বিনিময়ে পশু ধারে বিক্রয় করার পক্ষে রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লামের অপর একদল সাহাবী ও অন্যান্য আলিমগন সন্মতি দিয়েছেন। এই মত ইমাম শাফিঈ ও ইসহাকের।
Narrated Samurah:
"The Messenger of Allah (ﷺ) prohibited bartering animals on credit." He said: There are narration on this topic from Ibn 'Abbas, Jabir, Ibn 'Umar. [Abu 'Eisa said:] The Hadith of Samurah is Hasan Sahih Hadith. It is correct that Al-Hasan heard from Samurah, this is what 'Ali bin Al-Madini and others said. Regarding (the prohibition of) bartering animals on credit, this is acted upon according to most of the people of knowledge among the Companions of the Prophet (ﷺ) and others. This is the view of Sufyan Ath-Thawri and the people of Al-Kufah, and it is the view of Ahmad. Some of the people of knowledge, among the Companions of the Prophet (ﷺ) and others, permitted bartering animals for animals on credit. This is the view of Ash-Shafi'i and Ishaq
